Now legal. Wut 'bout landlord trouble?

Now that I can grow six at a time in Cali (3 in veg ,3 in flower). Can my land lord still threaten to kick me out. I know I won't be hearing "I'm calling the cops if you don't cut 'em", ever again. About 3 years ago he did while trying to show him my medical license. It was legal but I didn't want any more trouble from LAPD. They can be dicks. Especially when called out for non violent matters... They don't get to blast at people...

Not sure how it works in cali but it went legal here in mass and a landlords can prohibit tenants from smoking not from using edibles havnt heard anything about cultivation but you rent a unit not "the" and being a tenant there's always the contract renewal where you could end up screwed. I'd stay stealth or find a buddy or spot for outdoor.just how id look at it,not worth losing apt or maybe it is...

Got a point. Definitely not worth losing my apt over. Although my neighborhood has been getting shakey since the whole mexicans vs Don Trump mess. Lol might have to start thinking of relocation. Thanks for reading.
Do you know your landlord wouldnt be cool with it?

Most general lease agreements contain language that prohibits "drug manufacturing" (so do HOAs) and even though the state says it is legal the Feds do not so he has grounds for eviction. Damn that law school paid off for a second....
its like that here in Oregon also,, apartments,, govt housing, trailer parks, all say no to growing, or smoking

You need to read your lease agreement. If there is no specific language prohibiting it, then no. They can't.

But they can if your lease contains any language that:
  • specifically states controlled substances
  • specifically covers marijuana
  • specifically covers environmental issues as well as waste, smell, potential damage to property, peaceful enjoyment of others, and things of that nature.
The last one is what they normally will get you with as it's worded VERY broadly and can be interpreted accordingly.

All of that said, if there is no specific language covering any of those issues in your lease, then no, they can't evict you for it.

But they CAN append the lease to forbid it, give you 30 days to get rid of them, and then evict you after that if you fail to comply.

That may change with jurisdiction (the time frame to modify a lease). So look into all of that before you even consider doing it.

Stealth is a very bad idea in a rental. It shows a flat out effort of deceit. In any instance where there is language in a lease barring growing, should the landlord find a stealth setup they can actually have you removed in 24 hours, not 30 days.

Be VERY careful with that. Remember, there is NO lease agreement where the land lord doesn't have the right to enter and inspect the property at any time.

I am a landlord. I know the law on that.

You get caught growing against your lease, I can evict you in 30 days. You get caught stealth growing, I can have the sheriffs department at your front door in 24 hours to toss everything you own and you into the street.

That's all there is to it.

And pal, no stealth in the world is going to protect you from a person unlocking your door, walking into your house, and looking around every room in it and finding that grow.

And it's all perfectly legal and within the rights of the landlord.

Roll the dice if you want. The only reason you don't get caught is dumb luck. If not for that, you'll be one of those on here posting about how they got caught and wound up in a huge tight spot...or worse.

I hear ya on this. For sure. And I can certainly appreciate a stealth job well done.

In legal states though, it would be nice to grow with some peace of mind. Some landlords are pretty understanding (some not). If people have their shit together, and proper equipment, we let them go. We have definitely shut down some sneaky grows though (no police involved).

Personally I just wouldnt grow in a rental. If I did though, I would try to get permission.

Thanks everyone. I hope this will help others with the same question without having to put themselves in the spot light. I doubt jail is an option now.

Legal or not, state cannabis laws has nothing to do will your landlord/lease agreement. Just like pets, old leaking vehicles, etc. landlords can refuse lease or kick you out for whatever reason. Hell, your neighbors can shut your operation down (and possibly get you evicted) if they report it to the authorities because your grow or odor is affecting them (whether it's legitimate or a lie). I live in CA too and have seen legal grows get shut down or kicked out of the house one too many times.

AND, if he is on a month to month rental agreement instead of a lease, the landlord can give a 30 day notice at any time, without giving a reason.

Build a box to grow in that u can put everything in and lock, if they ask what's in the box tell them its none of their fucking business. End of story. they cant just look through your furniture.
Yes we can. If we find something like that in OUR property, we have every right to know what it is. If you refuse to let us examine what is in the box we can call the police and have them open it.

You really need to educate yourself on the law before you wind up like the countless other people that THINK they know their rights that are completely clueless about them that wind up doing 18 months in jail over it.
