It is Patrick Frederick's assertion in Section 4 Paragraph C that caught my attention:
"C. The MMMA provides an affirmative defense to persons supposedly involved in the provision and use of marijuana for serious medical conditions. A “patient” is allowed to possess up to 2.5 ounces of “medical marijuana” or maintain up to 12 marijuana plants. A “caregiver” is allowed to possess that same amount of marijuana for each of up to five “patients.” A “caregiver” who is also a “patient” can therefore possess up to 15 ounces of marijuana OR up to 72 plants and still maintain a defense to prosecution under Michigan, not federal, law. MMT manufacturing operations typically include 72 or fewer marijuana plants, but intercepted cellphone calls include discussions of having 300 “clone plants” at a time in some locations."
He quotes MMMA civil law (section 4) yet refers to the affirmative defense provided under Michigan's criminal law (section 8 ). He does so while excluding and ignoring the uninterrupted supply of Section 8 that clearly contradicts his stated licensing requirements of Section 4 that he wrongfully sites as Michigan criminal law.

What right does Patrick Frederick (DEA) have to ask Federal Magistrate Judge Joesph G. Scoville for warrants in this state at the request and based on Kent Area Narcotics Enforcement Team's (KANET) "Operation High Mileage"? And to opine on Michigan Medical Marijuana law to boot?

That was Friday brother! Today they dismissed those charges they had brought against them and then released on personal-recognizance bonds for. This whole thing is obviously a bunch of shit just about to hit the fan IMOLet's hope our media can do it's job of exposing this corruption for exactly what it is. Without a free press we necessarily have tyranny just like this ...
The media has come a long way in the last 10 years in regards to MJ but, still has a long way to go.
As far as world news and covering our government, it is scary how dumb they are trying to make the
masses.
My father was a VERY laid back guy and I would never hear him yell or swear unless he was watching
c-span or the news. I have learned from a birth not to believe a word they say and to always try to
do my own thinking. Public Education and the media are the two biggest things that we need to fix fast.

People like to talk a lot of shit, especially folks like this. I'm guessing taking these selective eavesdropped bullshit stories that are quoted as fact didn't pan out in reality. I'd argue the same reason that these warrants should have never been submitted, signed or executed: Integrity.

If (I stress the word if) the facts of this case are correct, then I don't really feel sorry for these people. They're fucking stupid, greedy, and careless. I have no issues with people wanting to grow 100's of pounds of weed, and get rich off the proceeds ..... but they need to be prepared for the blow-back if it comes their way. They are operating under the guise of the medical marijuana law. There are people that genuinely need this medicine. It's nothing but a front for these people apparently.
I feel sorry for the folks that are trying to stay within the boundaries of the law and are still being fucked with by police. I feel sorry for people that have 30-40 plants, and are a couple pounds over their allotted weight because they just harvested, or because they have a cancer patient and need to have a couple pounds in reserve for oil.
There is a big difference in being fucked over by police because you were a few ounces, or even a few pounds over .... and people that are sitting on 500 lbs and buying houses and cars from the proceeds of their racket. I don't hate them, or even wish anything bad on them. I just shake my head at them. And I certainly don't feel sorry for them.

The "facts" of this case, of which we have only be privy to the accusers/states side thus far, should be irrelevant as to the states manipulation of laws to justify their use of force, search and seizure in this matter.

Completely agree. I think the issue St0w raised is one of expectations. The tyranny ain't over yet. I think I'd wait until I had the Big Green Light before I started selling pounds on the street.

I agree with that. When police bust down the doors of someones house and weigh root balls, and wet plant matter to make their case then that is indeed a miscarriage of justice, and the police are abusing their powers. When people are sitting on 500lbs of weed, and are wire tapped saying the things that these guys supposedly said, then their is no "manipulation" going on. These guys got greedy, and it bit them in the ass.
There is a distinction to be made here TheMan. You cannot possibly lump together people attempting to be compliant, and people outright manipulating the law like this group did. We can all agree that weed should be legal, but that is a different conversation. Until it's made legal, we have laws and boundaries set forth by the people of this state. People attempting to stay within the parameters of that law and still getting caught up in shit by over zealous police deserve my sympathy. These guys do not. Apples and oranges.

No, and I am not lumping these (27) individuals that were "found" to have (500) "plants" following a warrant accusing them of conspiracy to distribute 100 kilograms MJ that were later dropped with your mythical individual somehow found in possession of 500 pounds either. I can neither see nor accept this fine line you talk of as it is without question unreasonable in my view. This undefined fine line you speak of is clearly a subjective product of manipulating and overlapping unrelateable laws as an unjust means, wholly disconnected to any stated/just ends. History is littered with the destruction of this exact same tyranny my friend. It will build upon itself until it kills it self, not so different than a cancer.

Think of the patients diagnosed with terminal cancer whom may have spent months suffering through chemo as they try to jump through all these MMMA loopholes and waiting periods to receive relief and now that hope, time and effort have now been wasted. Does complete and utter disregard for the only clearly stated part of the law referring to law enforcement "will not impede access" not anger you?
Find these patients now, as only they have the standing to be heard by the state. Find them capable council and have them work together to file a class action here and now. Let's get the ball rolling in the name of those patients in need, not the characters accused in just this one case.

That's precisely who I'm thinking of. I treat a couple of them right now free of charge. This group stands to ruin this medical marijuana program for people with cancer who truly need this medicine. This is exactly how the feds, the police, and local lawmakers want to paint us all. Greedy lowlifes scamming the system to get rich.
I have two beefs with people like this:
1) They're greedy. I don't view people like this any differently than I do fat-cat wall street bankers who are willing to game the system and fuck people over to satisfy their own personal greed. I see it in all walks of life, and I'm equally disgusted by all of it.
2) Why don't they just set up shop and grow the fucking weed? Why use the medical marijuana system as cover? In the process they are potentially costing very ill people the opportunity to use this *medicine* to either save their life, or drastically improve the quality of their life.
I may have misread the "500lb" statement as I did not read the entire pdf in full, but either way they were wire tapped discussing being broken in to and losing a 40lb crop worth a $100k from one home, so you can't pretend that they were growing this weed for their patients. It was a large scale for-profit operation. If they want to do that, cool. But I'm supposed to feel sorry for them? No fucking way.
And again, I am basing my opinion of this on the truthfulness and accuracy of the report. I am well aware that popo has a track record of stretching the truth.

Under most circumstances I would agree with that comment. In this instance, I do not. I think it's selfish and greedy to use the medical marijuana program as cover to operate a large scale operation. It is my opinion that cases like this will be used in the court of public opinion to try and take down the MMMA. If that happens then very sick people who rely on this medicine will pay the price.
