Quicksilver Delivery Service contracts to deliver Pete's Pizza Parlor's products to its customers for $5,000, payable in advance. Pete's pays the money, but Quicksilver fails to perform. Can Pete's rescind the contract? Can Pete's also obtain restitution? What does it mean to "rescind" a contract? How is a contract rescinded? What is restitution? How is restitution accomplished? Explain.

Are there performance metrics they must meet laid out in the contract? Can you provide documentation/evidence of poor performance. Usually if either party violates a contract it is null and void. You may have to pursue in civil court.

what this dude said.

the contract must specify what constitutes breach. usually by performance metrics that can be reported, documented, and analyzed by both parties. if you did not include any penalties in the contract for failure to perform you might be screwed.
