Caregiver?

How do I, (CA med PATIENT) name my spouse (same address) as a caregiver? so that i could grow double the amount? Or would i need another patient to do this?

Thanks for they reply, but if that was feasible it would have been done a long time ago. unless you mean to just get information?

If i designated her as a caregiver would we be legal with double the amount allowed?

If she is a patient then you don't have to be her Caregiver as long as your a Patient as well, If she is the Patient and your not go to the ASA web page and they Have the Forms(Primary Care giver).. Have her fill them out and get a Copy of her I.D. as well as Dr.s Rec, Keep them in your grow area and you should be O.K...
If you are both patients then you are allowed to grow for your needs...
I am not a Lawyer, This is some friendly knowledge thats all!!

California State offers a Primary Care giver Card as well as Patient I.D. If your really worried get that..You are then Covered by State Laws!!

thanks man.. i found out that it is just an agreement between two people and its best to get it in writing and have it in the grow area.

Yes it is, Get the Forms off the Web site. Also have get copies of the rec and I.D. and have them in the grow area at all times.. Remember it is federally illegal, Not State!! I hope you have a great experience in your garden!!

whoa whoa whoa. first of all you yourself can only grow within your county guidelines, it varies, it could be 24 plants in no more than 64 square feet which is what i got or it could be more. second of all you can't just appoint your wife as your caregiver and grow twice as much, that would be nice though.

Your Caregiver is the person that assists you in all of your needs and products.So many people list their boyfriend or girlfriend so as to giving them legal status,This is not how it works.Your caregiver is your grower and provider...........Your spouse or Friend needs to get legal on their own merit or illnesses.I wish you all would get your heads out of your asses.:clap:

Whatever.. i am legal she is not. She doesnt need or want to be. All i am saying is wouldnt it be safer for me to just list her as my caregiver in case anything should go wrong? so that she doesnt get in any sort of trouble? I stay within my guidelines, and i have a friend who is going to list me as there caregiver so i will be legally growing for him too.

Form a Collective, Private Patient Group.. To make your wife your primary caregiver you have to fill out the forms and do the paper work, You can go to the County Health Department in O.C. and pay150.00 to have her become your caregiver, She does not have to be a patient...

(d) "Primary caregiver" means the individual, designated by a qualified patient or by a person with an identification card, who has consistently assumed responsibility for the housing, health, or safety of that patient or person, and may include any of the following:
(1) In any case in which a qualified patient or person with an identification card receives medical care or supportive services, or both, from a clinic licensed pursuant to Chapter 1 (commencing with Section 1200) of Division 2, a health care facility licensed pursuant to Chapter 2 (commencing with Section 1250) of Division 2, a residential care facility for persons with chronic life-threatening illness licensed pursuant to Chapter 3.01 (commencing with Section 1568.01) of Division 2, a residential care facility for the elderly licensed pursuant to Chapter 3.2 (commencing with Section 1569) of Division 2, a hospice, or a home health agency licensed pursuant to Chapter 8 (commencing with Section 1725) of Division 2, the owner or operator, or no more than three employees who are designated by the owner or operator, of the clinic, facility, hospice, or home health agency, if designated as a primary caregiver by that qualified patient or person with an identification card. (2) An individual who has been designated as a primary caregiver by more than one qualified patient or person with an identification card, if every qualified patient or person with an identification card who has designated that individual as a primary caregiver resides in the same city or county as the primary caregiver.
(3) An individual who has been designated as a primary caregiver by a qualified patient or person with an identification card who resides in a city or county other than that of the primary caregiver, if the individual has not been designated as a primary caregiver by any other qualified patient or person with an identification card.
(e) A primary caregiver shall be at least 18 years of age, unless the primary caregiver is the parent of a minor child who is a qualified patient or a person with an identification card or the primary caregiver is a person otherwise entitled to make medical decisions under state law pursuant to Sections 6922, 7002, 7050, or 7120 of the Family Code.


So in my opinion I am a care giver if I provide a safe environment for my patients and I provide them with a healthy Medicine..Hopefully this helps!!

Its still illegal cause shes not legal, if the state wants they will drop all backup for you and throw you to federal law if you break limitations and rules.

Now that's a good idea, but how much is your friend going to get from his plants, it wouldn't be fair if you grew it all and he took it all, I mean you would be paying the electric bill, you would buy all of the equipment, and you would be caring for the plants, and he just sits back and let's you do all of the work? I would only hope you would get half of his plants. Good luck man, you had better have one awesome and not greedy friend.

Its not like that, he will take what ever i give him. Most likely a couple zips, and he will be happy. Any thing beyond that and he gets a discounted price for expense.

You already said you wanted to list her and grow more.Try growing what YOU need and let her do what she needs to be legal.:roll:
