I posted a glass piece up on Ebay for sale, and a couple hours later, a lady calls me telling me they are deleting the ad. I went home to check my email, in which they included their policy. It's ok to sell a pipe there, as long as it isn't glass. WTF. Below, is a snip from the email reflecting the publicly available policy, and my reply to that email.
Ebay policy is as follows.............. Although this item may be collectible due to the uniqueness of its design, the DEA considers pipes made of certain materials to be drug paraphernalia and we therefore do not allow them to be sold on the site. We do allow the sale of pipes if they are made of wood, ceramic or stone, as long as the listings do not contain any description of how the pipe can be used illegally.
MY REPLY AS FOLLOWS............Your policy assumes that both the buyer and seller, both clients of yours, are in no uncertain terms, criminals. Gee, thanks. The better assumption can be made however, or verification provided to you, that I live in a state where medication has been made legal, no laws are broken, yet you are helping to deny people their medicine and the tools that they need to both prepare and use it, again withing the laws of their state. There is no law to base this policy on, only an opinion given by an office that has no legal authority, and is not only against the constitution, but the laws of the states whose people have voted. Those rights are protected under the Tenth Amendment
