B. C. - The imprisonment for two former owners and an employee of a Nelson store who were accused of trafficking marijuana is reported to have been lowered to conditional sentences on appeal.

The court ruled Paul Stephen De Felice and Alan Stewart Middlemiss, owners of the Holy Smoke Culture Shop, for one-year imprisonment. While, employee Kelsey Windrawn Stratas was announced eight months sentence.

The three reportedly filed an appeal to B. C. Court of Appeal, which discovered that the trial judge had committed an error in finding that they were at risk of re-offending.

As per a decision taken unanimously, it took aim at those advocating an end to the current criminal marijuana prohibition, the court highlighted that not abiding with the law does not allow one to break it.

The three men, who have been granted bail, and surrendered themselves Wednesday, however, were speculated to be released after the court hearing.

At the time of their sentencing, the store had been in operation for many years and sold pot, cannabis resin and magic mushrooms apart from cannabis paraphernalia, food items, coffee and tobacco.

During the court ruling, their lawyer raised an argument that the business lowers harm much in the same way as Vancouver's Insite project, where addicts shoot up under medical guidance.
