Oroville, CA – The Butte County Board of Supervisors has set a special meeting for Wednesday, May 4, 2011 to consider the adoption of a Medical Marijuana Cultivation Ordinance (MMCO). The Board will also hold a public hearing to consider adopting fees related to the proposed MMCO. To accommodate everyone who wishes to attend, the meeting will be held in the Elks Lodge located at 1705 Manzanita Avenue in Chico. The meeting will start at 5:30 p.m.
On February 22, 2011, the Board of Supervisors held a public meeting and considered adopting a MMCO. After listening to many hours of public comment, the Board directed staff to make modifications to the proposed ordinance and fees. As a result of this direction, staff has proposed a revised MMOC. Some of the changes to the MMCO are highlighted below:
1. If the premise is 1.5 acres in size or less, no more than 6 mature marijuana plants can be grown with the required setback of at least 15 feet as long as other conditions of the ordinance are met.
2. There are no registration or fee requirements for anyone growing 6 or fewer mature plants regardless of the size of the premise as long as other conditions of the ordinance are met.
3. If the premise is greater than 1.5 acres and there are more than 6 mature plants, annual registration is required with a fee of $285.
4. The maximum number of plants, minimum set back requirements, and annual registration fees for premises larger than 1.5 acres in size are summarized in the next page along with a comparison to the MMOC originally proposed on February 22, 2011.
5. There is no zip-tie requirement as previously proposed.
