this was in MD . we were pulled over for speeding. the officer gave me a "speed greater than reasonable" ticket and then asked me to step out of the car. he said he smelled pot. (which had been smoked earlier so i believe he did smell it) he asked me if he could search. i got quiet and he searched the car anyways. he found the bag (2 grams maybe) and asked who it was. he said i can either man up and be honest and get a citation or i can be quiet and get arrested. then he tried to pin it on the guy i was with. i fessed up and he let me go. he wrote my info on a notepad and let me go. he said i would get a summon in the mail. do you think i will get one since i never received the citation before i drove away? it just seemed fishy the way it went down. if i do get the summon, should i lawyer up? i really dont have the money but id rather not go to jail. a fine and probation is reasonable but jail is out of the question.
what can i expect from a first time possesion charge of about 2 grams and a bowl

IMO you should have called a lawyer immediately after. You need real legal advice at this point. All I can tell you is according to NORML it looks like you could get hit for possession and a drugged driving thing. They both carry the same maximums, up to 1 year in jail and/or $1,000 fine. That is no substitute for real legal advice. I can really only list off sentencing guidelines, a real lawyer will be familiar with what sentences people are actually getting. They will know what your chances are.

First of all, never talk to the police, and ask for a lawyer immediately. They're not kidding when they say "anything you say can and will be used against you in a court of law." You confessed. I'm not sure if your silence to his question can be construed as consent to search, but he wouldn't have needed it anyways if he had smelled it. Either way, consent to search makes for a stronger case.
If it helps, I know a girl who got a DUI from pot in PA and got off with a year of probation. I doubt they'd push for time.
As an aside, I would NEVER smoke or let anybody smoke in my vehicle. Cops lean way in to check for the smell if they suspect it, and they will almost certainly smell it, and that gives probable cause to search it without your consent.
If I were carrying 2g on me and there was another individual in the car, I'd get the both of us to eat it all before the officer made it to the car. That way they can't nab you for possession.

.,... where do you live? this is why i like canada legal up to an oz, but they throw it out if they catch you with it driving. but still ive had easily 5 oz taken from me over the first 2 years i started driving (4 years ago) then i lost my lisence for being high when i wasnt even high, maybe even first time i was pulled over not high, but they were smoking a jont in the car so i got a 24 hour prohibition.

my blood bro was coming from ill and he was in a friends truck and as a cop came to the car he stuffed 2 joints in his mouth and was chewing on it while the driver was being talked to. pizza box on dash was a great cover never even asked a thing. eating is the key. though has he searched he would have the 3rd that he dropped while trying to eat all 3 at once.
