A. Do you have a communicable disease; physical or mental disorder; or are you a drug abuser or addict?
_YES _NO

The cops in Scott's Valley near Buck and me, use the excuse they thought they saw me toss a ciggy. It has happened twice now, on Sat night as I'm leaving my father-in-law's place.

After, License, Registration and Insurance, Law Dog sticks his head in to smell, and says, "Oh, you are not smoking. Well, I'll be darn. Have a safe drive."

Me? I like that. I never smoke in my car, and I want drunk drivers and racists hunted down.

Hopefully they will soon pass laws that police and law enforcement of any kind do not have to abide by the Constitution at all. Hopefully we can all have weekly "surprise" inspections by the police to ensure none of us are terrorists. I know I would feel alot safer knowing that 99% of the population was behind bars being paid $.30 a day for 16 hours of hard labor..

Hey, they have the 9th A, the same as we do.

All will be adjudicated. But, until then, if not strictly forbidden, it is completely allowed.

if not strictly forbidden

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized

Strictly FORBIDDEN by the 4th.

Look up the word 'Shall' in a legal dictionary.

There is no other path to follow.

The court ruled that the circumstances were suspicious when taken together.

They specifically said, "While driving posture, in and itself is not enough, yada, yada yada."

They just passed a law here that cops don't need a search warrant to search your car during a traffic stop.
Should be an easy enough law to overturn since it does not comply with the Constitution and all laws whether state or local MUST comply with the US Connie. Get a lawyer/

I know the difference between shall and will. If it was strictly forbidden and not widely interpreted by SCOTUS, you would be in better standing here.

SCOTUS has plenty of Rulings on this. If Nug's State thinks they can suss the 4th with some kind of public safety claim, it is up to the People to bring the matter for review.

That is because it is the People of his State that elected the boneheads that think they can get away with it. They can until they are stopped by a Federal Court.

Not shall and will, shall and May.
