A former Xavier University basketball player who was expelled over what he says was a false rape allegation has settled his lawsuit against the school over their handling of the case.

Federal Judge S. Arthur Spiegel dismissed Dez Wells' lawsuit against Xavier on Thursday, saying the two had resolved their conflict.

Wells' attorney says the settlement terms are confidential and declined to comment further. A university spokeswoman declined to comment.

Wells' lawsuit accused the school and its president, Father Michael Graham, of damaging his reputation by expelling him over a student's 2012 rape allegation.

The student later declined to press charges, and a grand jury declined to indict Wells after hearing evidence.

Wells claims the university used him as a scapegoat to demonstrate an aggressive response to rape allegations.

Wells, a junior guard and forward, played for the University of Maryland the last two seasons. He started all but one game this past season and led the team in scoring with 14.9 points per game.

Rape is a crime and a felony to be dealt with by law enforcement, not dumb ass college faculties.

Anybody that is claiming "rape" should contact the police.

Why is this even an issue?

Exactly! If somebody actually does commit rape then detention for a week, or expulsion from school is not a proper antidote, and if a rape charge does not stand up to criminal investigation, then that is the end of it. That is how the law is supposed to work.

Politically motivated Democrats on college campuses won't have it though. It is the war on men.

Wells said he had consensual sex with the student following a game of "Truth or Dare," during which he said the woman took off most of her clothes, kissed him, and gave him a lap dance.

Before the investigation was over, Hamilton County Prosecutor Joe Deters expressed his doubts about the alleged rape to Xavier President Father Michael Graham and urged him to hold off on any discipline until the investigation was finished, according to court records.

Now, college men accused of sexual assault are protesting the same system. Taking a page from the women’s complaints, men are citing violations under Title IX, the anti-gender discrimination law that women have used to demand equality in sports programming and education for 40 years.

Men are claiming the investigations are biased in favor of their accusers, who are most often women. Campus sexual-assault investigations represent a parallel criminal-justice system run by school officials without legal training in which evidence and the burden of proof are scant and punishments harsh, said Robert Shibley, senior vice president of the Foundation for Individual Rights in Education.

The sanctions, which can include expulsion from college are “massively life-changing,” Shibley said. The process “makes someone guilty of what in most states is considered a felony.”

In the past two years, men either disciplined or expelled have filed discrimination cases against Xavier University in Cincinnati; Vassar College in Poughkeepsie, New York; Williams College in Williamstown, Massachusetts; Bucknell University in Lewisburg, Pennsylvania; St. Joseph’s University in Philadelphia; and College of the Holy Cross in Worcester, Massachusetts.
