Old Boss Wont Give Me My Tax Return

I quit this job back in May and opened my own restaurant. Old boss took it personal for some reason. Employee friends of mine that still work there said they got their W2's already. I went there and personally asked him to give them to me and he told me to get out of the store. I'm afraid he's not going to give them to me and rip them up and blame the postal service for losing it. My question is what are my options for getting my tax return if he doesn't give it to me?

You can call the IRS to have them contact your former employer as well, but the Department of Labor is scarier. Like Dyna said they can't do anything until after Jan 31st though. He has until then to mail it.

OP I know all about this shit due to owning businesses... Their obligation is to put it in the mail to whatever address they have on file in January. If something happens to it after that they're not liable.

In other words, if you move or something and it gets returned to your workplace, they just have to show the dept of labor that it got returned and they're off the hook.

You need to email and then call your workplace trying to get it. Here's what you do after that-

If you don't receive it by Feb 14th, contact the IRS.
1800-829-1040.
You'll need to give them your name, address, social, employers address, phone number, etc, dates employed, an estimate of wages earned, and an estimate of federal income tax withheld, which should be based on your pay stubs kept from the job.

That way if you never get your w-2 and you've completed the above you still can file with a form 4852, which is an amendment for not having a w-2. Your return may be delayed but it's the way to go.

If you get the w-2 after you filed by April, you can still use form 1040x, and submit your w-2. Your return will be adjusted then.

Tell the tax office you cannot process your return and the reason why ASAP. Any pay slips you have Prove you are in the right. I know it sounds old fashioned but send him a solicitors letter formally requesting the release of YOUR personal info. Send it by courier so they have to sign. You'll get it sorted and you shouldn't really have anything to worry about, it's more the inconvenience he's putting on u.

Dyna Ryda is correct........as long as its post marked by 1/31/15 you can't do shiznit.....and good luck trying to contact the Eye-are-s this time of year unless your name rhymes with yomomma!!!!!

Everyone got their tax returns that he mailed them out to including people that work for me now. I haven't gotten mine. I wen back there today and he didn't answer his office door. I know he was in there his car was there and the employees said he was in the office. Hes hiding and hes a pussy. Id love to smash his head in twice but that wont get me anywhere He's not planning on giving them to me so that's that. I need to go to the next step after the cutoff date of sending them out which is from what I hear January 31.

and say what? I cant prove that it didn't get lost in the mail. Can I ask IRS for a copy?
You don't have to prove anything. Just tell them he refused to give it to you. The IRS will give you a copy, but it might take a long time.
