There were no 'Classified' documents on her e-mail server.

There were however over a thousand confidential, secret and at least a dozen of the most top secret 'Special Access Program' located on there.

SAP is a special category of information where the prosecution does not have to prove intent, just negligence with the data is sufficient for prosecution.

So, is she going to get prosecuted or do all you sycophants believe she is above the law?

If you don't go to jail for crashing the economy..whats all the commotion about?

People like her don't go to jail..they get fined heavily.

I love the nonsensical argument that the documents weren't classified when they were sent. They keep saying it like it will make everyone forget they were classified while they sat on a non-secure, unauthorized server.

There is no 'Classified' category for documents so her lawyer like answer is technically correct.

This isnt a financial crime, I am not sure there is a monetary penalty. I think it is just jail time.

I am wondering about timing. Right now the FBI would have to forward their findings and recommendation to the justice department which could easily decide not to prosecute.

However, if this dragged on for more than a year then there would be a new administration, one that might be less likely or unable to pardon Mrs. Clinton.

Mishandling classified information is a crime, a felony in fact. Markings are irrelevant. Top secret information is top secret whether it is marked "TOP SECRET" or not.

Hillary is guilty of mishandling TS/SCI information. That cannot be disputed. She did it. She might never be charged with a crime, because she has lots of connections, she is still guilty though.

Skylard is correct, I think, about a fine versus prison time. If she is charged, she will probably plead it down to a misdemeanor and pay a fine, just like Patraeus did.

What will be interesting to me is whether she drops her presidential bid when/if she is charged. She might not, and Democrats might vote for her anyway. It will be a delightful spectacle.

I think she will be charged. Just my opinion.

Federal Records Act, which became law in 1950, requires federal employees to keep copies of their communications. In 2014 Obama required federal employees to transfer personal emails to government servers within 20 days. But that change to the law was made after Clinton left the State Department.
Also it will have to show she SENT top secret information. Was it labeled as such at the time she sent it as as such ? don't think so or they would have had her ass already.

You must be confused. I am not carrying out the investigation. Once the FBI is finished they will give their findings to the Justice department. They are the ones that are probably not interested in playing lawyerly word games with top secret data...

SAP e-mails have a special protocol to even open so she cannot say she did not know what they were.

Yeah let me know when they find something. Right now I see nothing. I also suggest you learn what law was broken
