The State Department defines a treaty as "a formal, written agreement between sovereign states or between states and international organizations." While the Supreme Court has ruled that some international agreements don't need Senate ratification, the Paris agreement should be considered a treaty and treated as such.

Senate ratification is a critical component of the Constitution's checks and balances among the three branches of government. The process is meant to ensure that wide support exists for international agreements committing the U.S. to take certain actions or expend financial resources.

President Obama ignored the ratification process for the Paris agreement (not to mention others) because he knew the treaty did not have the support of two-thirds of the Senate — nor even a majority, for that matter. So he decided to self-ratify the agreement instead.


Obama didn't submit the treaty to Congress and he ratified it himself. He also didn't ask for financial resources or commit the US to take actions that would require Congressional approval. This was all a legalistic maneuver to position the US for a role in the changing world economy as it moves away from fossil fuels. It was the best move he could make for the US. Failure to honor the agreement will prompt lawsuits from rational people to test the legality of the presidential ratified treaty. Legal battles like this can take decades. Republican's tits are in a wringer. Can't just walk away, can't just say won't do it. Can cause a lot of harm to the US's standing in the world and to our own industries. Really, this is a dumb move on Trump's part.

The best legal way for Trump to end this treaty would be to submit it to Congress for ratification. Would surely end the treaty. Would also give a bitter edge to the ax held over some Republican Congressional representative's necks.
