Lol dude, even the article you quoted says what I have been saying, mainly, THEY STILL NEED REASONABLE CAUSE FOR A SALIVA sample. (Not a breath sample anymore though, they can do that for any reason).

Let us be clear: from the article you quoted, starting in December: "Canadian police officers can now use roadside screening devices that test saliva for the presence of cocaine, methamphetamine and THC, the main psychoactive ingredient in cannabis. Police will not be able to use random testing for these; they will still need reasonable suspicion before demanding the test."

Let us hope this puts this to bed for good lol. POLICE NEED REASONABLE CAUSE TO DEMAND YOUR SALIVA. Yes they can lie about smelling pot. Take it to court it will not hold up.

What GOOD does it DO trying to convince your fellow pot smokers that they do NOT need reasonable cause? We need to stand up FOR OUR RIGHTS FELLOWS! In the interest of the community it is BEST NOT TO MISLEAD people!!!

Oh, absolutely question EVERYTHING! I've never been one to submit because someone tells me to. What I was saying was cops will be cops, so even if you are squeaky clean they can find a reason that will stand in court. That doesn't mean you have to make it easy, even for the asshole ones. You can respectfully explain your interpretation of the laws and make the cop work to disprove it - if he can. Your biggest defense will be demonstrating that regardless of the level of THC they happen to find in your spit or blood, it did not cause you to be impaired. Asking intelligent questions, explaining your position and, if necessary, cooperating with the tests will demonstrate that. If you start acting defensive and uncooperative they will use that as a sign of impairment.
I get what you're saying about the bullshit of being stopped and tested without cause and I agree, I was just thinking ahead - sometimes you gotta pick your battles... I think cannabis testing for drivers will be very short-lived anyway...the average traffic cop is not going to want to dedicate an entire 8 hour shift to test and fill out the paperwork for one pot smoking driver, when it is likely to be thrown out of court anyway.

My points are:

a) if you are stopped they need cause to SALIVA you. So don't put pot leaf stickers on your car - that makes you a target, don't smell like weed, don't have weed residue on your dash or a bag of pot. Don't be smoking a joint or being an idiot. Don't say you smoke weed ever. This will guarantee in like 90% or more of cases that you are not even asked for a saliva test, because there is no cause.

b) if you are polite and do not provide a) above, they WILL NOT EVER ask you for a test. So that is important as far as I am concerned. Your blood (at the station after you fail a) above) will never be tested and sobriety will never be an issue).

I think the police in my city are only incorporating it to existing check stops which I almost never see. Even those tips are not enough if you want to avoid the cops ire entirely. If they see a bag of weed even in the back seat they'll make up some bs to saliva test you. I've had a cop breathalyze me because there were empty cans in a bag in the back seat. That was enough to be considered reasonable grounds to administer the test. I wasn't drinking so I didn't care but they're looking to rack up fines for their budgets.

Police forces in BC are not going to use tests except a roadside sobriety. A big part of the province is policed by RCMP, so they probably will - until the municipalities that pay them complain about wasted expenses. I predict '0' convictions for cannabis impairment.
