I'm assuming you're not in Ca or Co or you would be laughing at those peepers.

The best idea so far was the one about putting other plants in there. Put vegies and then share the harvest with the nabes before you go back to growing. Or just think about moving.



It's really confusing and there are constantly new cases popping up. I think it's best not to give the police reason to do a search in the first place. Growing in a shed is a lot riskier than growing in the home. Sheds don't have the same "expectation of privacy" as your home. Most agencies will get a warrant if they are going to search any structure on the property mainly to cover their own ass. Judges are more willing to give warrants for searches conducted on places like sheds or unattatched garages because the expectation of privacy is not considered to be the same as in a persons home. The bottom line is if the police suspect a person of growing they are going to find a way to do a search whether it's a "knock and talk" or they get a signed warrant from a judge.

The guy above is right, if there's a decent chance the case won't get overturned, and you're a high enough priority in your area, then I'd be careful.

BTW, if they heard from the neighbors that it was in the shed, wtf does it matter whether they would have to have seperate search warrants? They're gonna comnpile evidence and get one for every structure on the property, just praying you're that big bust that will get them recognized at the annual picnic next year.

But I think the best judge of your risk factor (assuming your neighbors tell the police "dudes growin weed") is what kind of priority are you? Is there a prolific gang running out of the house up the street, or does the PD there have a bunch of time and an overinflated budget?

The point I wanted to make is that most places treat structures on the property that are not attached to the primary residence differently. If the OP is renting the property that makes it even easier in most cases for the cops to search. Knowing the wording of the 4th amendment isn't enough here. There are things which are used to secure warrants like "reasonable expectation of privacy" and "curtilage" of the residence that are important to understand. Structures that are not the primary dwelling on a property fall into a gray area and depending on where you are and what cases are being tried these may or may not be defined as falling into the curtilage of the primary residence. The law is such a murky thing when it comes to the 4th amendment and probable cause, and unreasonable search and siezure. It's important in our culture to have some grasp of these terms and how we might be affected if something were to happen.

I would then find a way to invite the neighbors over in order to show off your new "hobby".

This may alleviate their suspicion and prevent them from considering turning you in.

Just because someone sees you go into your shed doesn't mean they know what youre doing, gawd I go into my shop all the time.

BTW, a cop can walk onto your property & into any building(even your house) if it is unlocked or he can make it look unlocked.all he has to say is he saw something that didn't look right. kids ran into your backyard when he pulled up the street,your front door was wide open in winter,whatever,he is expected to investigate anything suspesious(sp?).
if he breaks a cheesey little lock off your shed and claims he saw kids messing w/ the shed so he went back to investigate & found the grow,do you think the judge will believe that no kids were involved & the cop broke the lock(&the law) and throw your case out because no warrent was obtained?

cut now? dude, your all being paranoid. i go out to my garage everyday and have lights on and it doesnt mean im growing pot in there........does it? lightproof that bitch and stay the course. it'd be a shame to ruin all your effort now just cuz your a lil paranoid.

if you keep growing in that shed you need to make it visible that you have a new hobby and what the results are. Did you just start using the shed regularly for your new wood working shop, landscape shed (not suggested due to plants), painting, crafting, model plains? Good cover up for your time in the shed. I have a neighbor that spends all his time in the garage area. Wonder what his wife things of that? I would make some kind of semi regular noise. Like the saw of the wood sander etc. What ever works for you maybe leave something in the door way so when you open it they would see it.

actually this has happened to me before
when i was about 15 growing in my room.

i had 8 foot tall windows and the neighbors
seen my plant through the window, i just told
them it was a tree i brought back from florida
that needed a lot of sun light so i had to keep
the grow lights above it on all the time.

when you walk out of your shed make sure there looking and hold tomatoes or a vegetable in your hand so its like your growing vegetables in your shed

you have never talked to a lawyer have you? yes, judges WILL throw cases out if a warrant wasn't obtained. believe it or not, judges just want to uphold the law, even if it means letting an obvious criminal go free because evidence was obtained illegally. i know plenty of pro-bono lawyers who would have a field day with any detectives/DA's who try to pull some shit like that off...

it's exactly why the DEA relies mainly on snitches to make cases.... if not every house the cops/DEA thought had drugs inside would get busted into...

8 days early or possibly 8 months in jail..... Not a hard decision for me.... I don't want to even do 8 days in jail...
 
You're only a few days away from harvest. Even if your neighbors really want to get you busted, it would take way more than a week or two to build up a case to the point that a judge would actually sign a search warrant. If this is the case, you will have already harvested and there will be no evidence. Growing tomatoes in your garage wasn't illegal last time I checked.

The last few days isn't worth getting arrested. Pull the buds and dry them.. All the neighbors around here would call the cops like "That" if they found out I had around 40 plants in there backyard and they don't even know it =]]
