My friend got arrested last night after his home was raided like 6 months ago. The circumstances are like this....someone narced on him and said he had a meth lab at his house. Apparently this was enough to get a search warrant I don't know how that works just based on some bs testimony of an anonymous person. Anyways he did not have a meth lab in his house. They did however find a meth pipe and an empty bag of meth. Apparently there was "residue" on the bag-wouldn't that be considered paraphanelia? How is he getting charged with possession of a dangerous drug for a pipe and an empty bag? If you got caught with a weed pipe they couldn't charge you with possession of marijuana because of the resin right that doesn't make sense at all. Anyways he also had some trim left over from a garden and hes being charged with cultivation....wtf. In my opinion that would be considered possession of marijuana not cultivation I don't get it. Anything you may know or a link you could give me would be great they say that not knowing a law isn't an excuse for breaking it and the information can easily be found yet I have gone to a few sites and cannot find any information. Also this person has a medical mj liscense since this happened I'm sure hes going to lose it right? And that isn't going to help him with the cultivation/possession charges that came "before" that-even though he was clueless of what was going on until they came and arrested him. That's what I was told by him anyways they never told him he was being charged after they left and I assumed that some sort of papers would have to be served in order to charge someone and arrest them otherwise how would you even know? I'm not condoning his actions but he's still my friend you know it's just messed up.
The biggest tragedy of all though is that he still lives with his mom. When they searched his house or rather her house they found a shotgun that was not registered to him. They charged his mom with possession of a firearm! Now I understand how it might work for a minor but this was a gun hidden in the house which obv belonged to him and hes like 22 years old so how does the parent who had no knowledge of it get charged with it instead of him? Any thoughts info appreciated.
