My friend got arrested last night after his home was raided like 6 months ago. The circumstances are like this....someone narced on him and said he had a meth lab at his house. Apparently this was enough to get a search warrant I don't know how that works just based on some bs testimony of an anonymous person. Anyways he did not have a meth lab in his house. They did however find a meth pipe and an empty bag of meth. Apparently there was "residue" on the bag-wouldn't that be considered paraphanelia? How is he getting charged with possession of a dangerous drug for a pipe and an empty bag? If you got caught with a weed pipe they couldn't charge you with possession of marijuana because of the resin right that doesn't make sense at all. Anyways he also had some trim left over from a garden and hes being charged with cultivation....wtf. In my opinion that would be considered possession of marijuana not cultivation I don't get it. Anything you may know or a link you could give me would be great they say that not knowing a law isn't an excuse for breaking it and the information can easily be found yet I have gone to a few sites and cannot find any information. Also this person has a medical mj liscense since this happened I'm sure hes going to lose it right? And that isn't going to help him with the cultivation/possession charges that came "before" that-even though he was clueless of what was going on until they came and arrested him. That's what I was told by him anyways they never told him he was being charged after they left and I assumed that some sort of papers would have to be served in order to charge someone and arrest them otherwise how would you even know? I'm not condoning his actions but he's still my friend you know it's just messed up.

The biggest tragedy of all though is that he still lives with his mom. When they searched his house or rather her house they found a shotgun that was not registered to him. They charged his mom with possession of a firearm! Now I understand how it might work for a minor but this was a gun hidden in the house which obv belonged to him and hes like 22 years old so how does the parent who had no knowledge of it get charged with it instead of him? Any thoughts info appreciated.

One of my buddies got charged with the exact same thing, meth pipe and bag with residue. They just charged him with paraphanelia in court. As for the clippings, if he got his med MJ license after the incident, which i think is what you said, he can probably use that in his defense. I know that some states allow ppl with posession charges to get them dropped if they get a med mj license soon thereafter. The firearm thing just sounds like a lotta bs. Your friend should definitely hire a lawyer, a good one.

I grew up in Kern county(AKA-Kerntucky) which is basically the meth captal of the states. I have a good friend that is law enforcement of sorts and know the rundown of their priorities.

He is pursuing predominantly tweakers and also heroin users.

Your friend is probably going to do time with out a lawyer. The connections that the courts are making are very logical and he was busted with a oilburner..crack pipe..glass dick.. what ever you wanna call it, and a bag with residue. This guy has a pipe that has burnt meth residue and a bag that at one point contained meth. Looks bad.

He should hire a good lawyer. Probably get him out of doing time.
I would ditch the tweaker friend. I would talk to him and tell him whats up, see if he is willing to quit to preserve the friendship.

I didnt see the gun thing. If you friend also got charged with that fire arm, he would have been so royaly fucked. Mom took the fall to save his ass. Might have had cool cops that suggested this. Saved your friends ass either way, a difference between months and years I bet.

You are the company you keep, guilty through association. when I was kid, I was hanging out with a friend, after I left he went and robbed a house and i was implicated because I was seen with him earlier. Food for thought.

thanks for the posts but I know for a fact his mom didn't just take the fall for him they are charging his mom because it's her house. I just think that's totally fucked I mean she didn't know about it and the cops know them very well and know how he is (He's a paranoid skitzophrenic...really)I am hoping they are doing it so that he will just plead guilty to whatever they want to save his mom from getting charged but maybe that's wishful thinking. As far as thye company you keep it's true I hate tweakers I've been there and done that tweakers fuckin suck but the truth is he isn't my friend, he's family. You can't choose family and I have tried to tell him that tweakin isn't cool but he lives in the boonies and I am not there to babysit him you know?

Most judges will not issue a search warrant base on a he say or she say accusations...the authorities will have to collect some sort of creditable evidence to present to the judge in order for them to issue that search warrant... you stated your friend house was raided 6 months ago, so base on that assumptions, the authority have already gathered enough information and evidence for the past 6 months to bust your friend with a search warrant..(he should of been smarter knowing that the authorties were already on his tail)

getting charge with paraphanelia is less of a charge cause it is deem as just a misdemeanor in most cases or states so one should not worry to much there...
paraphanelia in general is any material that help facilitate the use of drugs..

that all depend if there was plants and equipments being present at the raid....possession of marijuana (given the amount) under most circumstances are mismeandor, so again not that big of a deal... cultivation is different on the other hand....regardless, if your friend is a mmp then his arguement is very defendable in court concerning the prossesion and cultivation issue...

his mmp status will be solely base on two things: the judge and the mmp commission that is usually set up in most mmp states to hear appeals or objections from the patient for their legal status... there won't be a particular link or site that will answer all of your questions.. however, one of a few things you can do is contact members from colorado in this forum and ask for help... another, but more constructive way is to find the info yourself because not everyone know what they are talking about (including me ).. especially, if its deals with law issues... try to google medical marijuana law in colorado and criminal marijuana law in colorado and come to your own conculsion of what is the best action to take...if this issue is important to you then expect to spend lots of time reading, researching, and understanding what those cases or laws mean to you or your friend... .Also look into case law regarding medical marijuana in your state so you know how the court rule for certain cases that was similar to you or your friend (learn from someone elses mistake so it don't happen to you in the future).... of course, we readers don't know the whole story so we don't know all that is entail in this story, but a good lawyer is always adviseable...

if he is 22 years old, he is not considered a minor anymore, but as an adult.. although you said the cops charged his mom with the gun, most likely it won't fly in court because she had no knowledge of it...if he is a minor, then the mom does bear some responsiblity there... either way, your friend would most likely be charged with the possesion of firearm so he might as well say its his so mommy can relax for a minute.. now, the question is that firearm illegal (i am talking about street guns and not a registered one)? if so, then take your buddy out to his favorite eatery cause it'll be a short while until you guys will share the same meal together again (unless if you want to join him )...

in this case, its not all the authorities fault here.... you have to remember the clumsiness of your friend and the people he surround himself with... second, he isn't on top of his game with the tweakin thing so he bear most of the fault here... The cops have jack shit on him. All they really have is paraphenalia. Of course they are going to try to trump up as many charges as possible in an attempt to try and make their horrible 4th amendment violation look good. There is nothing wrong with owning a firearm, the mother should be able to get any charge dropped with a decent lawyer. Time to say nothing and get a lawyer buddy. It will all work out. Hard to prove you are growing unless they have high powered lamps and seed evidence against you.

for his sake i hope your right drama but I can only watch in horror as it happens and wondering what will happen to them. They didn't deserve that, but the cops must watch their ass because they had a search warrant and can't come away empty handed right? Well I'm pretty sure they did have grow lights but no hooked up or used to grow the trim in question.(Iknow for a fact that was outdoor)
