According to an editorial published in the Marijuana Policy Project, the two prior convictions from the 1980s were, one for "drugs" and the other for packing a gun. It didn't say which happened first or give many details.

If a person is convicted of a "crime" for drugs, it's possible that peacefully carrying a weapon with a prior drug conviction may have triggered the "crime" of being armed.

Bottom line, it doesn't look like he ever hurt anybody. Sad.

It would depend upon what the other felonies were. If they were for possession, cultivation or sales of weed, then no, I would not be in favor of 35 years. In fact, if I had been on the jury, I would have voted to aquit, thereby hanging the jury. On the other hand, if the other two felonies were of a violent nature, i.e., robbery, rape, child molestion, etc ... I would have voted for the maximum sentence. Let's face it, there are some really evil people out there that NEED to be off the streets.

No, but each conviction is taken into account if found guilty.... am I wrong?

I'm "guessing" he either fled or was paroled. Now parole means walking the straight line or right back in. In effect you sign a promissory note to be good.

Now I LOVE weed.... more than most, but that has NOTHING to do with it.

Think it through. Know your surroundings and KEEP YOUR WORD. He didn't.

A coerced allegiance under the threat of a beating is no allegiance at all , and in a rational world this would be known as "cheating". Who threatens the victimless criminal with a beating? Hmmm.

Even if there are previous VIOLENT felonies? OK, call me evil, and I will call you obviously stupid. I mean, do you really want perpetual violent offenders roaming the streets? Do you like your daughters living among predators? Granted, you and I both agree on the weed issue, but come on ... at some point a guy has to learn his lesson, right? If he were caught shoplifting with prior violent felonies, would you feel differently about that?

So in essence you aren't for punishing him for his "victimless" crime of possesion? You would simply use that as the legal reason to "repunish" him for past crimes where there was an actual victim? Novel approach.

I guess if a person knew his history and felt he got off easy for one of his past real crimes, they might find it easier to rationalize punishing him for a victimless crime. Knowing how he's conducted himself in the last 20 years might factor into some people's analysis of how to apply "justice" too.

With the limited knowledge available of his past crimes, I'm still confident 35 years is unwarranted.

I do understand your point if he had committed a real crime against me in the past I might find it dificult not to feel some satisfaction in his latest
misfortune though. Karma?

No I wouldnt. When someone commits a crime and is caught they are punished for that crime and supposedly paid their dues. Why would you think its right to punish that person again for a crime committed 20 years ago as in this case? That is the problem I have with felonies, a person can make one mistake and for the rest of their life they will always be branded a criminal. At what point is a person absolved? I suppose to people like you never. Maybe if there were more forgiveness in the legal system people wouldnt feel the need to commit more crimes because they can never get a decent job, because even if 50 years has passed they will still be a criminal in your eyes.

The 3x law is unconstitutional as well as prosecution for crimes that have no victim with the state acting as an imaginary victim to control the behavior and activities of it's citizens. This is why the liberal was isn't working. Stand up for your rights! Ever single one of you should write your local politicians and Governors and tell them you want pot legalized and you want the Constitution upheld and to stop prosecuting innocent Americans. 3 Pot charges would get you life too, which is both stupid and undeserved.

We will be implementing this plan in the near future so you will have to choose to submit to the coperation of the Govt we have now or the Govt of the people awarded by the Constitution. This is the type of shit that needs to stop! I will start a new thread on this some other time...

Dr. Quinn, " 76% of Texans are pro-Medical Marijuana and 46% are for blanket legalization. However, 80% of those who are in favor of Medical Marijuana believe they stand alone in their thoughts."
So almost every body in Texas is for reform, but they are afraid to talk about it with each other. We need to wake up and start talking to our neighbors about this.

The article isn't detailed enough to explain it all, and that is a problem. I thought before he was on parole, but for 20 years? More info is needed here, but in any case, he did have UNEXPIRED time left from those sentences. Only more details will shed light on that part. Technically, he still owed time, and it was this additional charge which kicked those back in. A deal was cut so he could walk before, and this new charge breaks that deal and this guys word. In life, it is all about keeping your word, if you can't keep it, don't give it. Accept the consequences if you do break your word.

I agree completely with writing your representatives. Not sure about a militia. Some real nuts out there. Some patriots too I'm sure, but I don't think things have gotten to that point.
But I'll throw something out here, and let's see what you think.
Let's say that militia's become "in vogue" (that means popular DoobnVa), and let's say they spread across the country, and millions join up.

I know at 1st glance we think the militia folk are crazy but they are just average people who know their rights under the US Constitution and even liberals were on TV saying we will probably have a civil war in the next 20-50yrs but before that happens the people need to organize and stand up to this rogue Govt we have here. The Govt has robbed us of our rights and implimented priviledges like a drivers license which in order to get one you have to sign your rights away and accept it as a prviledge when it is a right to travel anywhere you want on US soil without having to pay a toll. Plus most tolls were put up with the promise they would be removed when the road was paid for yet it has been paid for 20x over and they still keep taking the peoples money...or by taxing the same dollar 30+x, it is wrong and the only way we can stop it is to all join our local militias so they have the numbers to impliment the Restore America Plan, and not the religious one that pops up when you google it though set on a similar premise but not holding any religion higher than another...

I have 90+charges on my record and none of em are violent but 40-50 of em are felonies cuz I used to have a heroin addiction and used to B&E houses. I have since gotten clean 4 yrs ago and only smoke weed now and built a 6 figure biz with God's help and now I am a positive member of the community and I actively do what I can to make the lives of people I meet better....but the point is if we had a stupid 3x law I would still be in jail and that isn't justifyable. People make mistakes and people that do drugs do it for a reason, they have issues and need help, not jail. I am hoping the guy running for sherrif in my area gets elected cuz he saidd he will have me as a guest so I can walk him through some things that are counterproductive at the jail....change happens but not by sitting around bitching avbout it.

This site has so many members, EVERY SINGLE ONE OF YOU needs to call your local Governor and state reps and tell them you want pot legalized and you want the offenses against the Constitution to cease immediately or else there will be reprecussions. You all bitch about it but if you all kept calling your local Govt they would get the message. Many of them still think pot is bad.

The whole bottom line is:

Marijuana is still illegal, and knowing the laws should be changed does not change the laws.

The police and other Government entities use the actions of people like this guy to demonize all Marijuana users.

If you want something changed, act within the law - hanging out at pre-schools with all the accessaries of a dealer hurts all of our positions on this.

This guy has done all Marijuana users a disservice by reinforcing the claims law enforcement makes against users to justify the current laws.

We have the constitutional right to do whatever we want if it doesn't hurt anyone else. And realistically it isn't even the Constitution that gives us this right, it is our God given right as people. No one should be oppressed for the benefit of anyone else, especially when it is all about money and not what is right and wrong.

Illegal or not, when the Govt inacts unlawful laws, it is up to the people to stand up and say enough is enough! Everyone can sit online and talk shit or bitch but when the rubber hits the road you don't do shit! Get off your asses and call your local politicians, let them know it wont be tollerated any longer and stand up for your rights or forever hold your peace cuz it is gonna get worse before it gets better but the time is now to contact people and tell them what is up. In a matter of months they will be officially be given an ultimatum so if people start letting their feelings known prior it will have a greater impact on what we are doing.

Don't make excuses for impropper actions taken against Americans by a corrupt Govt system. Hold them accountable! Sure, many people are stupid and make dumb descisions but if they aren't hurting anyone it is their right to make their own descisions. Obviously we need laws to protect people but there are thousands of laws designed to fuck the people and not protect them, those will be removed in the near future, I promise....or else I will die trying...along with thousands of other Americans. But if you all call your local politicians and they get the message there will be no need to get midevil on their asses. We prefer a peacefull solution though I personally don't think those in power will submit without a fight but if need be we will, though it is comforting to know that the military is behind the people and not the Govt...so it is all coming together and you are all about to witness a paradigm shift not seen since the founding of this country. Restoring the power and descision making to the people.

And then .... living in Texas and doing that.... is so far past stupid, you'd have to stop and ask directions on how to get back to stupid.

"drug-free zone" means a school. whether he was selling it or picking up his kid while smoking a joint is a different matter.

but having baggies next to a bag of weed does give them the right to charge you with selling

having anything (weapon, tobacco, drugs, alcohol) at a school is a felony- straight up.

added to other charges could add to the already fucked up sentence he is doomed with.

the weight of it don't mean shit- if you have more than 2 oz you are charged with selling-

the fact that he had pre packaged bags and more baggies and a scale makes the matter obvious

and he was at a school and he had weed- that's 2 or 3 felony's right there.

I'm surprised this state didn't ass rape him more.

In my county you'd probably be doing 99 years like vance wanted!
