We got pulled over in NC because my buddy went into a gas station and bought beer with his fake ID and the gas station attendant reported it. When we were pulled over we were told it was for "poking along" on the icy road. He got the drivers ID and the guy who bought the beer's ID. He asked if we had any weed in the car and we all said no because we didnt think there was any in the car. Turns out i had less that half a G in the car. They never asked if they could search the car and after the dogs searched the car and they found the pot i got arrested. They also found a bowl in my back pack that i didnt know about. Also, they found concerta that i'm prescribed to but i didnt have proof. I got a total of 5 misdemeanors: 2 for alcohol, 1 for weed, 1 for a bowl, and 1 for ADD med's that i have a prescription for but didnt have proof for. Anyway, i had a weed world magazine on the floor, is that probable cause? Was there any probable cause for the search? Also, i was never read my rights, what are my chances of just getting the whole thing dropped? Any help, advice, similar stories, or anything is much appreciated.

1) it doesn't matter what you 'didn't know' you had. what matters is what there was.

2) never consent to a search. never ever consent to a search.

3) watch the never get busted videos by the ACLU.

4) i highly doubt a gas station attendant can sell you alcohol, then call the cops. the guy has to say no if he suspects you of having a fake ID. businesses loose liquor licenses over offenses like that. that story was BS..... i have a liquor license, i know i can't sell alcohol to a minor, i could face a 10,000 dollar fine. i doubt the gas station admitted to selling alcohol to a minor with a fake ID knowingly....... highly doubt.......

i'm not from north carolina but the holy grail of getting and keeping permission to serve alcohol is convincing some board or council that you won't ever ever sell liquor to a minor, that you'll do everything possible to keep people from getting too drunk, and that your serving alcohol won't cause harm.....

admitting that you recognized a fake ID and sold liquor anyways is just asking for a fine, a probation hearing, another probation hearing, and finally a 'de-probation' hearing.... then your liquor bond goes up...... total cost could run 25-30 large...

No one consented to a search. I know it dosen't matter if i knew it was there... thats the same as 'i was just holding it for a friend officer'. I also thought it was suspicious that the lady sold it to us then called bulllshit... i dunno. I'm going to talk to a lawyer and see that they say.

I'm pretty sure weed is decriminalized in NC
LOOK ON NORMLS WEBSITE TO SEE IF NC IS REALLY DECRIMINAZED
you should look up all the laws, be polite and curtious

I bet they can drop it cause they searched your car without proof
plus as you said you were never given your rights.
you can get that lady fired also for selling it to you.
all she can do is tell you she CANT sell you the alcohol
and ask you to leave or call the cops right there and hold you
especially if she suspected you were underage and it was fake

cops are sneaky tho they say things like there is this problem
and we are going to search your car is that all right?
if you have nothing to hide then you would have no problem with the search
they make it seem like they are going to search your car no matter what
and word it to make it seem that you have no other choice.
so you may think you didnt give them permission but you probably did not even knowing
plus they are persistant they will keep asking the question and refrasing it till they get the answer they want.
