In Colorado, can i donate my extra like other states?

I am a legal and abiding mmj user in Colorado. I am listed on my card as independent meaning i have no caregiver set.

My question Is if i am producing my own medicine, more than myself and the another person growing in conjunction with me (room mate) need what are my options? I don't want to put myself at risk by being over the limit, and i am not a heavy user; mostly just during high pressure fronts or long periods of standing.

So what can i do with the excess? Can i "donate" it to a dispensary or what i have heard called a co-op? What are the legal considerations i need to figure in? What about other patients? Can they buy or trade services etc?

the MMED and CDPHE want you to destroy any excess to keep it from getting into the wrong hands. donated meds are currently a no-no (I think it is stupid though and they need to change it, esp. for the indigent patients).

that being said, you can look into a MMJ patient group (there are ALWAYS groups looking for excess donations, esp Cancer and MS patients)

+1 on the above...Be aware that he is not the only one.

Patient to Patient transactions have not been tested in the court system to my knowledge. So they fall into a grey area. You don't want to be the one to test it.

Best options are:
[1] Time you crops to where you are not encountering overages.. ie, rotate your plants to start one a month, then you finish one per month and avoid excess issues.

[2] Bubble Hash the excess and store the concentrate. Concentrates and bud count the same in regards to weight.

[3] If you did want to donate, I think a patient to patient direct donation might be ok. It would be totally legit if they signed you as caregiver to receive the donation from you, then switched back to themselves in 30 days.

We always encourage patients to grow their own, but not to grow more than they can use themselves. Saves a lot of headaches and legal issues that way.

bitches all up on craiglist with overages and asking for "donation" , of course the "donation" is a set price, usually competitive with most of whats going around. hell I just bought wax from a little ol lady up on craigs! it was a straight up ad though, said nothing about "donation". I often wonder how many people get busted like this. I certainly like the good prices and the quality wasn't bad too, thanks little ol lady! but I suppose you're talking actual donations of meds without a "donation" in return, thats awfully nice of you . personally I think the limits are ignorant here in colorado. Its not like I want to keep a grow going all the time, I'd like to see a limit that would allow me to do a couple grows a year and be happy.

I like number [2] but feel if you have enough bud to make X amount of concentrate ( I prefer wax) doesn't that still mean you're over the limit? I suppose as long as someone doesn't come knocking until you've extracted and got the weight down.

concentrate removes the waste/scrap/crap plant matter which is where the weight is. you could have 2oz of hash/budder/oil/wax/whatever or 2oz of bud per rules. based on milligrams per, you could have a LOT sitting around and not hit the limits if you do it right.

I think the answer would be yes, for a short period of time. This would be the same for you till you were able to donate the extra medicine you have. By making a concentrted version of medicine you will be like Eyecandi suggested you will be able to stay under your limits even if you can not find someone to donate to.

How are concentrates regulated so different from the herb and how so the dispensaries sell every form all fine and dandy?

You sure about that? I've never heard of it happening in Colorado.

I've never heard of it either. an edible with 100mg THC is still only 100mg (not the weight of the edible - as long as it was tested and labeled as such), so I could have a TON of edibles, as long as the THC weight adds up to 2oz or less. with kief/hash/oils - the pure weight matters. with buds, the pure weight matters (including the raw plant matter).

As far as patient to patient sales, be careful. I know for a fact that there are snitches and undercovers that are carrying cards.

In a perfect world where the state hadn't regulated the hell out of the industry, a patient who grows his own would be able to take his trim, shake, and/or flowers to a MIP and get it processed into concentrates and/or edibles in order to stay in compliance with the state or just to legally get his hands on some well-made infused products. Too bad we don't live in a perfect world. MIP's are having a hard time finding enough trim to keep their operations running smoothly these days. They sure could use the trim and I bet a lot of growers would like to exchange a little bit of their trim for some of the products that the MMJ industry is making in Colorado.
