No; they are crimes of action and expression. The thought is not at issue afaik. A fellow who spends his life thinking atrociously bigoted things, but never utters or illustrates them, is 100% legal, even if he's wasting good lobe. cn

What if i don't know he's gay and I'm just beating him because he took my parking spot? is that better? or does the crime change once it's established he's gay.

yes, it's not a hate crime if say a white guy gets into a fight with a black guy over say a parking spot or w/e.. there has to be an underlying reason for it to be considered a hate crime, ie, you got into the fight simply for the fact that he was black, or got into a fight with a gay person simply for the fact that they were gay..
at least that's the way i have always understood hate crimes.. they have to establish the fact that it was indeed a hate crime and not just a fight inbetween two people..

oh I'm sorry racerboy, i understand what a hate crime is, I didn't mean to give that impression. I just don't think they are necessary to be labelled as such. An asswhipping is usually bad no matter the reason, making it about race/religion/sex seems nonsensical. At least we can still beat up fat people or short people without it having extra baggage attached to it.

Aren't you happier knowing you were raped spur of the moment and your attacker didn't plan it? Imagine how much worse you'd feel later knowing your attack was planned days, or worse weeks in advance. It would anger me knowing I was raped cause my attacker thought I was gay. See, without hate laws, crimes are no longer done for warm and fuzzy cute bunny reasons. I want to know a person wants to fuck me right there and now, because we are so gay for eachother! Who doesn't want that world?
