I was reading an article about a caregiver in another state. He charges his patients for his caregiver service which includes helping to administer, delivery and meds for his patients. His state is no compensation for meds. It made me wonder if charging a flat rate for caregiver services would work here.
Maybe a flat $250 a month fee includes your expertise in methods of use and delivery of 2 ounces per month. You are not being compensated for growing or meds.

If it is your registered patient, the reimbursement for your "costs" are not illegal.
Potentially you could justify any price to your patient if you were creative enough, one ounce could be sold to cover all of your costs technically... (Not suggesting this because patients do not deserve overpriced meds)
The issue is asking for compensation from someone who is not your patient, illegal..
There is one full proof way to except donations w/o recourse and that is to have an entity that is specifically licensed to do so.

You can be reimburses for all costs incurred while helping a Qualifying Patient!!


I believe this was done to prevent middle men from dominating the MMJ scene... If you have no incurred cost you simple can not be reimbursed!

A true caregiver will have costs... Electric, rent, water, supplies... So on

Did you know you are required by Law as a caregiver to keep track of what is going Out to your patients?
You are required to keep track of expenses to show your incurred costs associated with help the qualifying patient. Everything...

How many do this? Out of 800+ caregivers in AZ

Read up on the Arizona Revised Statues!!

Right... But are you going to be consulting your designated patients? NO

You are allowed 5 patients as a caregiver...

If you are talking about providing to another caregiver or patient that is legit as long as there is nothing in value exchanged!!

The only way I see something working is like this...

Caregiver A has patient 1,2,3,4,& 5
Caregiver B has patient 6,7,8,9 & 10
Caregiver C has patient 11,12,13,14 & 15
So on

Patient 1 is caregiver B
Patient 6 is Caregiver C ... So on

And so on...

Never mind on that point mate!

My question... What are you consulting? Does your consulting involve providing meds?

Do caregivers even use a ledger?? How do they prove reimbursements without a ledger? Gurantee there is probably only 1 or 2 caregivers that keep a ledger.

Record keeping is a must!

You are licensed by the AzDHS to provide your service to a Qualifying Patient! You are a Primary to the Patients care in regards to MMJ! If you are a caregiver and the AzDHS does not see your patient getting meds from a dispensary... What do you think they will be assuming? Yes... The caregiver is proving to their patient! At that point you are liable for any and all transactions with your patient! Anyone thinking they will have SOOOO many tax write offs... Think again! Not only does the IRS not allow it, most do not keep records like they should to be eligible! I recommend to every caregiver buy quickbooks or some kind of accounting tool, a ledger, and a safe place retain these records! Every time you receive reimbursement from your designated patients, purchases, gas to deliver to your patient, and so on! Sounds crazy but the last thing you want is your card being revoked for some BS reason!

I did bring this up when speaking with the families lawyer, and you are spot on as a caregiver you can not be reimbursed but he said the consultations that I would provide wouldn't be a part of our caregiver patient relationship. As the two are unrelated

No laws against consulting?
I did talk to my families lawyer about this, and he said this was the cleanest way of doing it by the letter of the law, but also told me he was not a expert in all parts and loop holes in 203, but he said there is no law about providing insight into questions as long as they arent questions about things that are illegal. He is the familes business laywer so he did give me advice on how to start an LLC for consulting which lets me write stuff off on my taxes... but thats another story

On whatever you my need, could be gardening tips, veggies, fruits... could be cooking tips... nascar... the weather... whatever. meds can and would be provided upon request to 203 card holders but thats just a perk of the visit, has nothing to do with the money being exchanged. The money is simply for my time and expertise(lol i feel like a d-bag saying it, but i had too lol) on the subject you would like a consult on .
