a few glimmers of hope here, this decision immunizes patients who are acquiring meds from dispensaries or sources other than their designated caregiver, and accepts the word "sales" for the first time in a binding decision. it also does not mandate that communities close down all the dispensaries, it just says they can...
Why not pass an amendment via ballot initiative that addresses p2p, p2c, c2c, c2p and dispensaries? I would think that ballot initiatives would also be used to help protect from corporate interests. The opt-out of the word Dispensary in the bill was from fear of not passing if included. Now that the voters have had some time getting use to the term along with the businesses in the community, let the people decide but by way of introduction by the people, not the politicians.
So is it now illegal for a caregiver to provide for a patient other than the 5 patients that that caregiver may have?
That is why I plan to utilize the ballot language as to state state Both, Full out Decrim (no regulations) and legalization (for any use).I agree with a lot of this but full legalization stops folks from going to jail and decrim doesn't.... I've been charged with mj possession more than once. It aint no fun going to jail for anything but it's worse when doing it for weed.
5 or 6 years ago we were all for legalization but now lots of folks are making a living from medical marijuana and don't want that to change. Thing is, it just did for many of us. I saw it coming too. Have to admit I was hoping the SC would accept dispensaries but.....
I do agree with you about legalization and would be interested in helping to put together a petition for legalization. I've thought this out for a while. It takes a lot of work to write a petition, get it approved and collect donations and signatures. If we were to try and fix or amend the med mj law to allow patient to patient transfer and/or dispensaries we would probably fail to get enough support from the folks outside of the med mj community. Hate to see another huge effort all for nothing. Legalization on the other hand has an excellent chance of going through. We just saw 2 states pull it off and you know more are to come soon. A few cities in Michigan already voted for legalization just like they did before the state voted in medical marijuana. I say lets get our licks in while we can. If we lay down or play our hand wrong again they are sure to win. The time has come to shit or get off the pot! (no pun intended)
Legalization is a very welcome idea to many folks who are outside of the med mj community. Most of those people aren't troubled by the fact that Phillip Morris might be growing their weed someday. Collecting signatures for that last legalization petition was like taking candy from babies. I had most of my problems getting folks to sign who are involved with med mj, especially CG's and growers. They are threatened by the potential competition of big industry. I can relate to that way of thinking but i also realize that legalization is the right thing to do. Get busted for weed in small town Michigan and you'll find out it aint no joke..... They need cash and weed offenders pay their bills and give them a paycheck. It's time to quit making pot smokers pay the bill through the legal system and incarceration. It's also time to make marijuana readily available to everybody over 21. Alcohol was considered medicine before and during prohibition. You could actually get a permit to drink booze for medicinal purposes like we can with medical mj in many states.
Now that booze is legal again we can make our own beer and wine and we can even get a permit to make it on a large scale. Look at all the micro brewries..... I see the same thing happening to marijuana in the future. Yes the bottom will fall out and you will have to grow quite a bit to make a living but those who have a real love for growing will be the folks doing it.
I think lots of folks aren't quite as passionate as they like to think they are. There are lots of people suffering because their loved one is in jail or prison because of some f'd up marijuana laws. The pain and suffering doesn't only belong to people with medical conditions. I think lots of folks are putting their wallets in front of all that in the name of compassion.
Aspirin is medicine. it's more dangerous than marijuana but I can buy some at the gas station. Marijuana should be available at the gas station too. It should also be available at boutiques, coffee shops etc. In those places you'd find premo connisuer and med grade marijuana. Phillip Morris probably aint gonna start mass producing marijuana indoors, they are going to do that outdoors. It would be like wine, you'd get boones farm at the gas station and Dom Perignon at a specialty shop that only deals with high end products. I believe there would still be plenty of room for the small guy and lots of jobs would be instantly created for those who can't afford to set up their own shop. There is also the possibility of teaming up and creating llc's etc. The internet would be a great tool for that also.
Maybe we should start a new thread for those interested in legalization. Post the old petition and change the wording to be far less vague. Figure out how they worded it in Colorado and Washington and what probably worked. Keep away from special interest groups. We could write a new petition right here on Roll It Up or another forum if need be. If we are going to do this for the 2014 election we better get a move on. We have lots of organizing to do.
By the way I'm not a NORML member and never have been. I like to stand neutral to the organization and always have.
Really? How do you figure that?If you aren't ready to go to jail for your beliefs in this situation, you have no reason being involved in this industry or the marijuana movement. Medical or recreational.
The main effect was to put people on notice they needed to either grow or get a caregiver. Now it is the time patients should have been preparing for. All the dispensaries in my town shut down and stayed closed. I don't know about down state, lot more money and lawyers at their disposal there. The majority of them that closed their doors ended up reopening a short time later as well as many many new dispensaries opening. For the last year I've had more dispensaries within 20 miles of my house then I can count on my hands and toes. In the grand scheme of things I would say that ruling had a little effect...
i think there's more of us that fit that bill than the rare d's out there but i understand where he's coming from. real passionate guy for his cause but it's gonna take alot more of the mainstream hobbyists and guys(gals) who just enjoy growing and helping to make serious change i believe.Really? How do you figure that?
As a medical marijuana patient and caregiver that is also a husband, parent, and business owner, no I am absolutely NOT prepared to go to jail. Why should I be? It may come as a newsflash to you, but some of us have things in life that are more important to us than weed. I grow because it helps me, I enjoy doing it, and I am helping out others in the process. I stay within the boundaries of the law, and I don't flaunt what I have going on.
Who the fuck are you to suggest who should be growing and who shouldn't?
You make good points. Here's mine. We are hanging on by our fingernails with this act. We were given a list of rules in order to have access to cannabis, for the first time in over 70 years. MOST patients followed the rules, grew, got caregivers, didn't drive, etc. They were helped by the act.thats sound advice for the person giving it but a terrible attitude for activism (unless the first part wasn't sarcastic....which I think it probably was) Nobody would have medical if we didn't have Jack Herer and many others out there breaking laws getting in the face of the public and catching headlines to keep the general public in a state of angered contempt for the pigs that make and enforce laws the people don't agree with. Love you doc but you tend to play it too safe for my taste. Old growth forests don't get saved in congress they get saved when hippies chain themselves naked to the trees and get press.
Homeless, follow through with your thought... Why was it deemed a public nuisance. What made it a public nuisance? Read the opinion again and you will have your answer. This is the difference between reading the headline and reading the article. Go a little deeper and you will see why this has to do with the Act.Get em the fuck out of my garden... Period fuckin dot.
Go to jail for my beliefs? Nope rather go to hell. Where ever I go I will do everything in my power to cost as much $$$$$ to the courts and state as I can.
Dr Bob? This ruling was not about the 'act'. It was about public nuisance. Zoning. Anyone no zoning no problem.
As far as not liking new terms that are not spelled out in the act? Really ? Now all of our acceptable words are to be defined by 'the act'?
As far as Jesus thinkin your magic number of 12 does not make u a criminal? Really really? "don't be stupid while you are doing somethin stupid "...You are an admitted felon with 12 plants.
dr troll why dont you stop trying to tell us what to do .you keep saying we we we you arnt one of us this act isnt for you hell you arnt even a patient or caregiver .are you telling the dispencery in muskegon to close that is doing your clinic with you???????? today if not then your a hypocrite sir .your words are falling upon deaf ears around here .seems as if your becoming a troll trying to do bill shittys jobYou make good points. Here's mine. We are hanging on by our fingernails with this act. We were given a list of rules in order to have access to cannabis, for the first time in over 70 years. MOST patients followed the rules, grew, got caregivers, didn't drive, etc. They were helped by the act.
A few chose to get rich and make it a commercial venture selling medication for 20-25 bucks a gram, and they got the headlines. We had one 'high profile cowboy' dispensary owner open right across the street from the court house, while he bragged on facebook he was 'going to take back' the town and force the issue once and for all. Cops answered his door when folks came to his dispensary yesterday. Wonder who is going through his records now?
My goal is to sell this as 'normal' to the general public, routine medical care no more worthy of attention than insulin and a safe and appropriate alternative to harmful meds. In the face stuff- chaining yourself to a bulldozer in the amazon to save a rain forest is activism. Acting like an idiot to make a couple of more bucks until you become a headline is not activism. Mom and Pop Public, who voted for the act to help sick people, are going to form an opinion when they see the money, guns, huge amounts of marijuana, and criminal charges in the paper. You think it will be supportive of the program, or disapproving?
Want to be an activist? Help teach people to grow. Organize a compassion club where patients can find and meet potential caregivers, teach people to grow. That is what is allowed in the law. That is the framework we work with.
Dr. Bob
A good petition would set guidelines for dispensaries, commercial grows, coffee shops etc. Permit fees, basic location guidelines, outdoor grow rules, etc. Don't leave much open to the state and local gov't to make decisions on. Don't make it too vague and broad like the last petition. Set up a reasonable tax scheme. Have it all there in black in white, no confusion. Make something that is for the good of the people and allows fair play so the little guy can get in the game too. That is why I plan to utilize the ballot language as to state state Both, Full out Decrim (no regulations) and legalization (for any use).
