This is a funny thing, and a really dumb thing to sue over.
I worked at subway when I was younger, worked my way up to management when I was in high school. ( I know major accomplishment right lol and yes I smoked weed
when I worked there by the bag full and never got tested)
Anyways, the bread comes in boxes, frozen. The staff throws it in a pan and puts it in a "proofer" where the bread rises before being baked. Just like any bread that is baked it is not always
the same size as the loaf beside it. There are too many variables in the process that may differ.
That law suit is just a cash grab by some people who deserve to be drug out into the street and beaten for being an ahole.

I remember that staff, the proofers name was Mary, and she was great at making the "bread" rise. Funny how the proofer could never get our bread the same size. She sure knew how to stretch that wheat.

Yeah that laws suit is a cash grab for sure. But the reason only subway got sued for it is because they are the only ones with the name FOOT LONG, and if it's not a foot long, then it's false advertising. In a sue happy society, it's best to c.y.a. IMO. If they called it a large instead of a foot long, they would never have been sued.
