Caregiving operation at residence

Looking into becoming a caregiver in the state of Maine. Can anyone tell me if I started a legal caregiving operation at my residence if there are any zoning requirements? Do I need to be zoned for a commercial business? thank you

Zoning is a local thing, not the state. However, I don't believe you will find many restrictions unless you expect a lot of traffic. I suspect most people don't bring attention to themselves in the first place. You have a legal right to cultivate.

I don't think many caregivers give zoning any consideration. I haven't heard of anyone having issues. But if there are a bunch of jerks on the zoning board, and they don't like you, and you are zoned residential...they could try to shut you down. Zoning boards do really dumb things some times.

There are towns without zoning. And lots of stuff is zoned agricultural in Maine.

You have a legal right to cultivate.

That is more of a patient thing than a caregiver thing.

no need to tell the town anything....as long as you meet state setback requirements there is nothing the town can do....pay the state fee and do your thing...

General licenses to operate a business are managed at the town/city level in Maine. Contact your town office for information. To obtain contact information for your town office or to locate your municipal website, visit the Maine.gov Local Government portal.


Corporations must register with the State of Maine Bureau of Corporations.


Certain professions and types of businesses require additional permits and licenses



Any person engaging in a business as a sole proprietor, and who adopts any business
name, style or designation other than his/her own name must file, in the office of the
town clerk , a certificate of sole proprietorship in accordance with 31 M.R.S.A. §
2. Whenever two or more persons become associated as partners for the purpose of
engaging in any enterprise , they must also file a certificate in the town clerk's office in
accordance with 31 M.R.S.A. § 1. The fee for such filings is $10.00. The law does not
apply to corporations, which file certificates of incorporation in the Secretary of State's
Office.

Caregiving is not a dispensary; I don't think you have to worry about that, unless you make a big deal or draw business to your place. Most caregivers deliver product.
