Umm, in america, they say you're innocent until proven guilty but often times sit in jailfor well over a year before ever seeing a judge..
Just saying..

I'm not saying our judicial system sucks, but how many of us have ever been arrested else where for a point of comparison? Granted, there are a few countries I won't go to for fear of prosecution, but saying that, I've also been thrown in jail, no less than twice, for possession of under a gram of cannabis, and one time the amount was .04 grams.. .04, yet to jail I went..
IMO that's more a problem with laws than with the courts. It's bullshit that you were arrested for such a small amount but it's not the courts who decide who to arrest. Legislators deserve the most blame

Just make sure the evidence is good. There ARE innocent people in prison.

The fact that you are drawing conclusions simply based on what the charges are, before you see a shred of evidence, is scary as fuck.. I've been charged with rape and was completely innocent. I chose a bench trial because people with your mindset exist. Think about what clayton said.

France is even worse....Napoleonic system: you must prove your innocence
Yup and guess whose system of laws Louisiana is based on! You go to law school and it's english common law and oopsie Louisiana. It was like one of those awful english mnemonics ie before e except after C and Louisiana.

Here is a true story: was in the last 3 months of my MS, still had some lab stuff to do and writing the thesis....get called for JD and can't get out of it...for 3 weeks I sat there 8hrs a day in the waitroom...kept getting rejected.....looked like a hippie, too much education and a Viet vet...snakeyes dude everyone was afraid of me for one reason or another...fucking hated it...but I finally get called and seated:

The city of Glendale was bringing charges against this kid who ran a hotdog cart. The city was acting on behalf (they have to) of a pizza place who complained the the hotdog cart violated statutes. Kid was putting himself through college and he was parked outside a beer saloon. The pizza dude was pissed cuz the kid cut into his biz as food couldn't be served at the beer place. Pizza place was across the street. Well the statute said vendor carts had to move 60ft away after 2 hrs. Kid did that, was perfectly legit....however I had to make the rest of the jury see that.

This was how the laws changed in Colorado...jury nullification. Although juries are sworn to uphold the law, there are no real consequences for ignoring it.

When juries refuse to convict, state's attorneys' offices stop prosecuting.

What a great system we have...err...when it can be manipulated from within.

You do know that jury nullifaction is Legal

He's not the trier of fact, only voting for or against the case going forward.
Yeah, momma, and before he decides if some poor bastard has to go to jail for who knows how long, and come up with money they probably don't have for a decent attorney. They have to present a good enough case to indict at the GJ, no?

From what I understand the prosecutor basically gets to have their way with the grand jury. The defense does not get an opportunity to fight the charges during indictment the grand jury simply hears the prosecutions side of the story and makes a decision based upon the information that is presented. If they have enough "evidence" to make a conviction then the case will go to trial. When I had to deal with that shit, the police/prosecution version of what happened was way different than how the actual events unfolded.

Oh, you'll get indicted - even if you're just a "Ham sandwich".

Lets cut the BS here. Best bet is to go to the initial summons and at first opportunity to speak simply state:
"I strongly believe in the right of JURY NULLIFICATION and feel it is my responsibility to educate my fellow jurrors on this."
You will never be called again. You can try and put that in a letter but it will not garauntee they drop you like saying it in person.
Secondly I urge you to educate yourself on jury nullification

This is advice I received from a Sr prosecuter with over 10 years experience in Federal Circuit courts

Well I've gotten 2 or 3 of them telling me I have to fill out some form and return it as I was being summoned for jury duty, and I just pitched them.
In my former state it declares in the letter that if enough people dont participate they will send a sherriff to recipients to verify residence and if you are there you can face misdimeaner CHARGES. Don't want that do you?

I just got a letter, saying Grand Jury Summons :(
It's been so long I forget how I got out of it last time any ideals ?

I did write up a letter saying: I think the court systems is a bad joke and that I do not agree with the laws of this land, I just live here. If called on I could not alter my beliefs at the order of the court. Juror ID ***********
Ended with: You really don't want me on a Jury...

But have not sent it in yet... I really don't give a fuck about the court or there bullshit, If someone comes at me or mine I don't use the police or court I handle the problem myself what ever it maybe, so way should I be in there circus ?
It's a "Summons" from the court.............not showing up, will not turn out well............

What "my" saying is that you're condemning people based on the charges when they could be 100% innocent, and that is not right. Your (correct usage of "your") avatar is fitting.
