**For ONE immature plant...seriously Idaho?!**

Elmer W. Flicker, 50, is being held in the Ada County Jail on a charge of felony manufacture of a controlled substance after Boise police say they found a marijuana plant in his bathroom this fall.

Boise police arrested Flicker Sunday afternoon in connection with the case.

Boise police say they discovered the plant Oct. 18 during an unrelated call at a home in the 1100 block of North 29th Street. Police were given consent to search the home and found a marijuana plant in a bathroom that they determined Flickers was growing for later use, according to police reports.

That information was given to Ada County prosecutors, who issued an arrest warrant for Flicker earlier this month.

While it is unclear how much marijuana the plant was able to produce, prosecutors charged with Flicker with the felony under Idaho Code section 37-2732.

"Idaho code says if you are growing pot, you are manufacturing it," Boise Police spokesman Charles McClure said Monday.

Flicker will make his initial court appearance later Monday. The charge is punishable by up to five years in prison.
