clubs are going to keep getting raided

I see there is an effort by law enforcement to raid clubs.
This is due to the fact that dispensary owners are making a big stink about them to the state to shut them down.

I don't know, the way i see it, a well run club is pretty safe. They just can't cut any corners or they will get busted.

There was a article in the paper a few weeks back I guess dispensary owners were telling the politicians in AZ instead of trying to get rid of the MMJ law they should target compassion clubs who operate illegally.. It was posted when that douchey politician from Fountain Hills was bitching about "teens getting access to MMJ"

If no one has seen this correlation yet I am surprised...

Law Enforcement
Courts/Jails
Dispensaries
AzDHS

All have a common interest in the AMMA... Money!

Law Enforcement - has already expanded their operations (Compliance Officer)
Courts/Jails - Warrants being issued against clubs and MMJ user and folks filling the 90% capacity agreement with the private prison corporations!
Dispensaries - 25 Mile Rule monopolizes the whole medical marijuana cultivation, production & distribution
AzDHS - Collects a fee from all the patients/caregivers/dispensaries/dispensary agents/dispensary license/permit to operate

And this is just a quick rant....

And if you look closely they all go hand in hand! Conflict of Interest!

In essence, the dispensary has the police departments and courts under them giving them complete immunity from prosecution for cultivating & distributing MMJ! What the State did not anticipate was a fight against the corp thrievey they are trying to do by restricting folks that live with 25 mile of a dispensary! Yes the police will be coming after the home cultivator next!

FYI - Kimberly Yee from Glendale is planning to introduce legislation in the House to allow the police to throw out confiscated medicine/plants/edibles/concentrates so on.....

Seems like we will begin to work backwards in 2013

It's all about the "donations". IMO that's why the markets have been safe, they're staying away from that model. I would like to see the police reports and how many convictions actually come out of these. Anyone know how to find that stuff?

I don't see how any of the clubs could ever be legal anyways. Don't get me wrong, i don't like to see anyone get busted over MJ, but it seems pretty clear in the AMMA that you can't sell meds unless you are a licensed dispensary. I know there are different loopholes people try to come up with to try and say the meds are free, but come on. anyone with common sense knows you don't go to one of those clubs without any money and expect to walk out with free meds.

I have posted about this before, but believe it is pretty important Case Law: http://www.lvrj.com/news/judge-dismisses-medical-marijuana-indictment-129697013.html

Huuhhh vague medical marijuana statutes. Where there is vagueness in the law there are arbitrary arrests that follow!

Reminds me of the AMMA. The State controls every aspect... Even the distribution which is getting tightened due to Organix opening in town! Wonder what shall take place when the 120 dispensaries open up.

that is awesome.

I'm all for taking advantages of loopholes in the law, especially when it's being done for a good reason like to provide medicine for patients. What I meant in my earlier post though was that's obviously what's happening - loophole probably isn't the best way to describe it but in reality we all know it's a sham... all the paperwork they have patients fill out to say it was free medicine etc... it's all just a ploy to sell their weed but still be able to say they are giving it away free. If it works, then I'm happy for them, I'm just not so sure that kinda defense would stand up in court (in this case the jury didn't get to decide if that defense holds up, it was thrown out cuz they never even got to hear all the evidence supporting that defense). I definitely agree with the judge though, whether it's valid or not the jury should have seen all the evidence supporting it. Definitely awesome that it got tossed out. It would be even more promising if the jury actually got to decide based on ALL the evidence that he wasn't breaking the law.

I say good luck getting most medical cases past a pre-trial grand jury.

Especially ones where they are covering their own ass with paperwork stating the medicine is free.

No I think many large marijuana cases in Arizona could get past a grand jury depending on the evidence
the prosecutors submit and we all know how the corruption in Maricopa County is. Farther there is the possibility that the police would put false statements and other fucked up lies in the report being submitted. With that said comparing things to another state
does not mean so much as all the laws and court rules are very different. Lets also remember a grand jury only decides if the case should be heard
(indictment) but does not find guilt. The fucked up thing is many people will take a plea bargain with mmj if they dont have about 10k for
a good attorney that does more than just plea bargain and knows how to stand up to the state in trial.
