confiscated package

i've been trying to find the penalties of cultivating under federal laws but those numbers are being rather difficult to track down. An idea of what your getting in to:Vermont - NORML

i don't mean to scare people away from this hobby but it is important to know.
 
lol you guys, just look up your state laws on drugs, go to google and try that. if your looking for a "united" law, there is no such thing and will always vary on states, even down to the county (like my state).
 
we're looking for the federal law. basically if the DEA were to come knocking on your door and find X amount of plants/seeds what kind of penalties would you face? we're(at least i'm not) not worried but it's always good to know.
 
Interesting little tidbit I've heard, though I'm not sure if it's verifiable, but I remember reading it in a few places that had some decorum to 'em.

According to Federal Law:
You can get charged for having a plant.
You can be penalized for having a seed.
But they can't do shit if you have an unrooted clone. Apparently, according to the Federal statutes, in order for it to be considered a plant it has to have:
1) foliage
2) roots

Kind of amusing if it's true, eh? There are a lot of little loopholes like this in various laws, so I'm inclined to believe that it's actually true.
And for the record, yes, state laws vary, and if you're caught by the police, that's how you'll be charged. But there are Federal penalties as well. You're only charged with these if the arresting agency is a federal agency, such as the DEA. And from what I recall, they're rather draconian. I mean... look at the penalty Timothy Leary got for having a single roach! Though I'm sure they've been amended since then.

If you're looking for the federal penalities, there's always Erowid. I wouldn't be surprised if the penalties themselves are listed in the the Controlled Substances Act, or other similar statutes themselves. The DEA site is probably also a source of information in that regard, though I would personally be wary poking around in there, if I were actually growing.

One might also want to check NIDA. You know, the people who supply marijuana to researchers but meanwhile won't allow anyone access to it unless their study is specifically aimed at upholding prohibition.

that's interesting...so what would they do if the person they were trying to bust decided to hack down all their plants? the person would have plants but not attached to roots, and roots but not attached to foliage.
 
Thanks fdd, but i still cant find anything about seeds, or is there no distinction? if so as long as i have 28.5 g or less of seeds i wont go to jail?

It varies from state to state- for example in California seeds are not considered Marijuana as far as posession goes.If you have less than 1 oz. of bud or leaves they can write you a 100$ ticket- no arrest for it. In other states like Nevada or Arizona, if they find a seed in your carpet they can put you in jail for I think up to 3 years.Honestly you wouldnt actually do any time for a first offense.You really dont want to get caught growing in a state like Arizona...bad news bears.
 
wow ive been told that nirvana doesn't stealth there packages well that must sure have changed!

i sure was sweeting pretty good when i walked up to the teller to pick up my package. and i swear she was in the pack for 30 min when for every one els she took 30 sec. but i got my package took home it and after about 15 minutes of searching the contents i found my baby's wish me luck :) largest seeds ive ever seen maby ive always only seen underdeveloped before.
 
looking foreword to my first grow, and i ordered some seeds from nirvana but when i check my mail yesterday i had one of them "sorry we missed you " orange papers asking me to come pick it up at the post office. now I'm pretty scared! now armed with the info that seeds = plants im not sure what to do hehe rookie mistake i guess.

the exact same thing happened to me but i just went, collected them and now i have 2 6' plants! haha
