Cops on the patio above my apartment

Urgent help and opinons please!!!!!

Just a few moments ago I heard cops in the apartment above me on the patio talking about my patio below.

I have 3 small plants about inches tall outside... not really growing them just put them out there to die. Also have four pots filled with soil that are empty.

I head the cops talking about my patio saying things like: It looks like it could be a ficus (talking about the small plants), "There is nothing there anymore" (talking about my empty pots).

Now, I am legal for California standards as I do have my doctors rec. What I am worried about is my indoor plant which is close to harvest and my few that are currently vegging indoors.

What do you all recommend that I do? Cops just can't bust into my house w/o a warrant, can they?

Note that the lady above me is in her 80s, and she is clearly not doing anything illegal, hence no reason the cops would be there.

Don't trip. You've got a few plants OTW out and barely there anywho, plus you say you're a legal MMJ patient. There should be nothing to worry about if you're under your limits in every regard and have your recommendation handy with a photo ID.

And if you are over your limit, either chop to the legal limit or move them out to friends.

def get your paper work ready and by the door. dont give those pricks a chance to ignore that you are a patient if anything does go down. it is really hard for cops to get warrants for a few alleged weed plants by heresay. however if they think they see it with their own eyes they prob have alot easier time getting a judge to sign it. def just make sure the indoor grow isn't violating obvious electrical codes, and as long as you only have the legal limit of plants you will be ok

Ok, thanks for all of the input... I am under the plant limit, so i don't think I have anything to worry about.

I'm sure the cops will be knocking on my door the next couple days .... that should be fun.

I'll let you know how I handle the cops and how they approach me.... if and when they do.

Why were the cops on the patio above yours? Did someone narc you out and call them to report you? Who lives upstairs?

def keep us updated on this man. very interested to see if the convo you overheard will lead to a warrant. hopefully not though, cuz most people who grow on a small level in cali or any other medi state have their card. why would we risk this exact situation (illegally though) for no reason? law enforcement, as always, needs a fuckin reality check

I highly reccoment watching a movie called "Never Get Busted" made by former DEA agent Barry Cooper. It is a very good video that shows you your rights, and what NOT to do. One of his BIG rules is: NEVER OPEN THE DOOR FOR POLICE!!! If a police officer does come to your house and knocks on your door, this is what he said, and I quote him in saying:

"I don't open the door for police. If you want, you can have your dispatcher call my cell phone or we can talk through the window. If you have a search warrant, here are my hands, kick the door in."

I doubt the old lady ratted you out, come on she's 80 and can't see 20 feet away. I suspect someone else called them and they just knocked on the door and asked if they could use her balcony. Now did you have your other plants outside anytime in the passed week, I suspect that's might be why they stopped by.

As soon as you open the door for police, they can say they can smell something, for example, and they then have probably cause to search your house. From there it can get pretty nasty, and all because you opened your door for police. It is your own right to open and or not open your door to your property to whomever you feel. Police are no exception unless they have a warrant. And landlords have to give you notice before entering without consent.

Not sure how they found out because my patio is only visible from her location, and it is BARELY visible. I'll be on the edge of my seat for this next week waiting for something to happen.

you should be ok with the cops if you are under the limit, but i would worry a bit about your landlord. the cops don't have to bust you, they can just call your landlord and allude to the fact that they think you may be growing. some times that is enough for management to need to "come in and fix something" just to check it out. but remember they cant come in w/o giving you 24hrs notice.

if the cops are insistent about talking to you face to face, refusing to open the door makes you look guilty of something. you don't want them calling the swat team because you are "Barricaded" inside your house. this takes a bit if prior planing on your part, but it has worked many times for me. first put a spare key in your wallet or some other easily accessible place. when the cops show up, step outside, paperwork IN YOUR POCKET!! (make them ask for it) lock the door nob behind you. try to do it "accidentally" and "forget" your normal keys inside. hopefully you can deal with them and get them to leave. if they want to look around refuse, ask them why, and ask for a warrant. no warrant, they cant come in. if you make them kick in the door your landlord will probably make you pay for it. now if they wont leave after they fail to produce a warrant, then you can tell them to have a nice day and leave, go to the store or a friends house. they dont have the man power to try to wait you out. when they are talking to you they will try to trick you to go back inside, once you do they don't have to let you close the door, personal safety reasons. then they get a nice look around to try to find some "probable cause" to enter the house. something as simple as money on a table can sometimes be enough. this is where the locked handle comes into play. while talking to them you will be nervous, they will probably trick you. when you go to open the door, "oh, crap its locked," feel for you keys, DONT PUT YOUR HANDS IN YOU POCKETS!!! "awww! i left my keys inside!" then turn around and SHUT UP!! lol dont offer a solution or an explanation. if they ask what you are going to do say "i dont know ill figure it out later, can i have your card so i can contact you when i get back in side?" this now gives you his full name, if his badge number isnt on it, memorize it! dont write it down! you should memorize badge numbers and faces when confronting any LEO. now leave, on foot, unless they are detaining you then they cant stop you. be aware they may follow you for a bit. go to a public place, grocery stores are great! they will eventually get bored. after a few hours you can go back you your place, take a friend back with you just in case the cops are there (he had your spare key . remember its a crime to lie to a cop!)

If that old lady lives alone, she is probably desperate for having someone to talk to and would probably let anyone in just for the company.
That said, they also have all the time in the world (or what they have left) to look out the window and watch the world go by.
Maybe get to know her a little. Offer to carry her groceries for her when you see her with some. Just common everyday small talk.
Give here a little conversation time here and there she just may become a 2nd set of eyes to watch over your property.

yes its wonderful to have neighbors i live in texas and i am friendly with all my neighbors i ask them to watch my house when i leave and have never had problems

The fact that they said "there's nothing there anymore" makes me think you're in the clear. That statement was for the old lady's benefit.

If they wanted to pursue it, they probably would have come knocking right then and there, hoping to ask a few questions and trip you up...maybe catch a whiff of the naughty weed.

If, for some wild reason, they want to get a warrant, they will be digging through your trash. If your toilet was clogged up for a few days it would seem reasonable to send a few logs out with the garbage. Don't throw away any mail with your address on it with the "special treats".

I don't know what state you're in...but if it's Cali, you're so in the clear. They came to check out my neighbors plants, verified paperwork, and went on their way. He put up a greenhouse the next day and maxed out his plant numbers. What the hell...they were already there...why not do it right.

I know you're scared, but just relax. Make sure you don't have a scale, or a large supply of baggies, or anything that could spell "dealer". Get through 1 more week and cansider it a done deal.
