Do you medicate at work?

I know employers need to accomidate you and let you consume your meds, has anyone actually gone to there boss/HR said "hey, take a look at this and i expect your support" kinda thing? maybe not so direct but you know...

I have seen a article with a lawyer being interviewed and the question came up; his response was that its federal law mmj is licensed under and employers need to start accepting that employees may have these needs.

I don't get why people treat this as some sort of illegal medicine, none of their fucking business! You wouldn't tell them about the pills that get you all stoned up before so why tell them about medicine that is legal for the chosen few. Would they have a shit fit if you needed to inject insulin or whatever at work.... your probably going to do that in secrete too.

So unless they ask .... no fucking need to tell. even if they ask unless it has to do with something medical you still don't need to tell them. they can ask your doctor.

At my facility we have an official health and safety policy that will allow our employees to medicate at work. There are some stipulations though, you must provide a doctors note, our facility will be a non smoking environment, so we have designated our first aid room as a place to vaporize only. No medicating in your car at the facility, for liable reasons. Don't want people medicating and driving. You will need to use our provided vaporizer, and to be supervised by a superviser in the first aid room while you medicate. Other than that it will be treated like any other med.

Actually its not that straight of an answer as an employer you are obligated by law the make every effort to make sure the work place is safe. Allowing someone to take any medical drug at work that could cause a safety incident could get you to be charged and get a monster fine.

If you come to me saying "Hey I got this here prescription that lets me smoke weed and I'll do it at work whether you like it or not" I'd throw you the fuck out. If you come to me in a non holier than thou way we'll talk it over and I'll do whatever I can so that you can take your medicine.

if you terminate an employee who is legally allowed to possess and use marijuana simply based on the fact that he wants to get high at work aka "use his medicine", isn't that unlawful termination of his contract?

Being a dick head and putting my business and your lively hood in jeopardy because you couldn't talk to me/your employer straight pretty much voids that and I can come up with any reason to let you go. If you think weed is just like any other medicine then why are you afraid to talk to the employer about it? Its stated pretty clear in the Occupational Health and Safety act that an employer has to make every effort to make the work place safe if they fail in tha,t the fines are enough to put any small business out of business.

The supervision part is kinda weird but I guess if the employer supplies the "medical" equipment the first aid attendant/supervisor has to attend.

cannareview, you cant just fire someone for using medical marijuana. Your hands would be tied when a human right tribunal heard that...until you had to sign the patients settlement cheque.

As jackal said, you dont need to tell them you have a mmj license but the attitude wouldnt get you far. Being straight forward would be the best bet. Give your employer all avenues to accomidate you and if that fails continue to lawyer.

itsmehigh; how do your employees feel about being supervised?

If you come to me hostile, your attitude will not be part of my business and I can get rid of you in plenty of ways and give the job to someone who will need it more then you. Like I stated before approach me and Im sure many business owners in a normal way and most will accommodate your medical needs.

Re-reading what itmehigh says, its a company provided vaporizer so I'd imagine a first aid attendant would have to supervise for liability/insurance reasons.

attitude? nah yer getting it wrong, the attitude part was to express how much your employer need not know your business, well if you want to smoke/vape while "at" work .... then excuse yerself or at a smoke break, leave the property light up, they can't say shit.... unless your dumb enough to have a driving job.... but sitting at a desk ... fuck come on common sense!!! god your boss is probably looped the fuck out on anti depressants anyways. I wouldn't say shit unless it effected your ability to work that job in the first place, then maybe it's time to change o jobs o

The employers responsibility under the law is to make sure the work place is safe. If you come in stinking like dope then its their business why you stink of smoking dope or are high at work. This goes for any medical drugs.

Smoking is legal, if you stink like dope and I don't know you have as persecution for weed as far as I'm concerned you're high on an illegal substance at work. If you eat a cookie and you're looking all fucked up at work I will ask you whats up. If as a business owner you don't like how I run my business you don't have to be there but I will make sure everyone else is safe while under my supervision. I've told people before to go home as they were too hung over and I wasn't about to watch them cut their fingers off because they're sloppy and a danger to themselves and others.

If i work for you and i came in stoned, eyes red and a little bit of smell i would prepare for you approaching me and asking whats going on. If you came to me un-professionally and i got told "you dont have to be hear because i have to keep my people safe" i would tell you i have rights as a employee and you need to accomidate my medical needs. If you over all do not feel safe with me doing the job then you would need to give me another task to do that you feel safe about me doing, keep in mind my hours or wage would not change. There is something called un-due hardship. Meaning i cant overly cause you hard ship financially.

If you tell a employee to leave/your fired/go home without pay/never come back you should be sued a hefty amount so you never treat someone like this again.

A bit of a off example; i have a mmar script and im in a rental. Form A says "if you do live in your primary residence blah blah" got in a arguement with my brother in law, went down to the LLTB in mississauga...HC is federal. I trump all laws below and i can grow in a rental. My federal authorization umbrellas over the provincial and municipal laws. I have seen a article of someone in NS getting appropriate power to there rental via LLTB for accomidations. Same goes if i live in a home and get paralized...they need to put a ramp for my wheel chair.

You don't read do you? Never did I say I wouldn't accommodate any one if the came to me saying they have any kind of prescription. Now if you got all hostile after being asked why you look smell/stoned and told me its not my business I'd make sure I got my money worth out of your wage.

Where did I say I was ok with someone taking phara at work that might affect their judgement/motor skills while doing work that might endanger others.

Ok sorry yeah, they do need to tell you. Im sure this is why itsmehigh has a designated vaporizer, they are meeting full accomidations to there employees. Understand tho that if you dont feel safe with the employee doing a task you need to find another with no negative influence to the employee i.e. wage+hours

yeah he don't get it at all, small business owners usually don't know shit about employee employer laws/rights.
If I'm hired stoned .... because lets face it, most here have a permanent high going, whether it's from narcotics from an pharmacy or an LP... were permanently stoned all day long... if you ever met me you would have no clue except for a lil glassy eyed.... but I work a lot and I'm a bit tired ... you hired me ..... I worked through probation... now got full time... you find out I smoke MMJ, you my friend have to live with it.
