So my old land lord... what a bitch. So about three months my landlord comes over without any warning. (This is a usual occurence) She pretty much pushes her way past me and walks through the house.

Eventually she makes her way to the garage (Oh shit...) She notices the giant plywood box and doesn't say anything. This is a 8x8x10 box so it is pretty much impossible to miss even for the blind. She goes to the broken washing machine and talks to me about it for a second. She then leaves without gaining any evidence of the grow.

I am a cannabis patient in California so its not like I am doing anything WRONG. So generally I am not worried. A little while later we receive an eviction notice. No real reason, just evicting us in 30 days (she delivered it a little late to be a full thirty days and this is where all the hilariousness begins.)

So we move out on the day that was specified or earlier and got all our grow torn down and generally cleaned up. Over a month after moving out one of my roomates runs into the cunt on the job. She is very smily and tells him that he is going to be in big trouble etc and that she almost lost her house because of us. She continues to say how we owe her a lot of money in addition to not receiving any deposit.

Weeks later yet again roughly a month and a half after eviction we finally end up contacting here for a bill of what we 'owe'. She sends the bill certified as per the law but does so over 50 days after the eviction.

So in the end I got to write up this response for us to her bill. All I can do is sit back and laugh because this lady is harassing use, black mailing us, and generally being a foreign cunt from sri lanka who has no idea of how things go over here.

Her bill was for the entirety of the deposit (4200 bucks) and 800 on top of it for further damages/ penalties.

Here is the letter.



"Dear Ms. Blank
Upon receipt and review of your bill for deductions from the security deposit at 301 Via El Encantador, I have determinded that you have made illegal charges of $3960.08.

Your charge of $1700.00 for the painting of the interior of the premises is in violation of California Civil Code Section 1950.5 subdivision e.

Your charge of $195.00 for the repair of the washing machine is in violation of California Civil Code Section 1950.5 subdivision e.

Your charge of $885.58 for carpet and labor is in violation of California Civil Code Section 1950.5 subdivision e.

Your charge of $332.00 for a broken toilet is in violation of California Civil Code Section 1950.5 subdivision e.

As the premises were vacated by the thrity first of august, and you did not make yourself available for the return of keys until the ninth of september, Your charge of $847.50 for unpaid rent is in violation of California Civil Code Section 1950.5 subdivision b.

In addition, you failed to comply with California Civil Code Section 1950.5 subdivision f, parts one two and three, which states you are required to notify me in writing of my right to have an initial ispection of the premises and be present at that inspection.

In addition, you failed to comply with California Civil Code Section 1950.5 subdivision g, which states that the security or the bill for the security must hand delivered or mailed first class, postage prepaid, within twenty one calendar days after the tenant has vacated the premises.

As stated in California Civil Code Section 1950.5 subdivision l, the bad faith claim or retention by the landlord or landlord's successors in interest of the security in violation of California Civil Code Section 1950.5 may be subject of statutory damages of up to twice the security deposit plus damages as determined by the court.

Therefore, you have forefit your right to any part of the security deposit. Please send a check made out to blank for the amount of $4200.00 to blank as soon as possible upon receipt of this letter. If no response is recieved within a reasonable ammount time, legal action will be taken.

This lady was generally a slumlord, we left that house in better condition then how we found it.

We had to remove a ton of garbage from throughout the house just to move in.

If she had approached the situation slightly better she could have maybe had a few hundred dollars to fix up the place a bit. Instead she thought something illegal was happening and thought I was to dumb and a little girl who wouldn't stand up to being extorted for renovations that are not my responsibility.

Luckily in california code the burden of proof is on the land lord. She has no proof. Of anything. We have pictures, of everything.

Mostly the biggest thing is that according to california code we have to be notified of when the 'inspection' takes place within 21 days. Didn't happen which = forfeit of money on her part and possibly damages.

How long did you live there? In Oregon where I live the landlord can't charge you for carpet or paint after you have lived there 1 year. As for the broken washing machine if it just died during normal use and you did not physically abuse it fuck her its called normal wear and tear. I fucking hate slum Lords more than used car and traveling meat salesmen put together.

I fuckin hate those meat salesman. They come to my door all the time "You wanna buy some steaks?" No. If I wanted to by steaks I would go to the grocery store, where the meat is refrigerated. Not from some idiot knocking on my door tryin to sell me steaks that been sitting in your busted ass volvo in the blistering summer heat of florida.

We lived there a little over a year and a month, the laws are the same in california. Wall dings, carpet stains etc all become normal wear and tear after a year.

The washingmachine was circa 1978 or something dude. Its probably the first one ever brought to the house. She is lucky it still works.

Honestly I did a lot around that place fixing it up. I re ran pipes under all the sinks cause some joker didn't know a thing about plumbing efficiently. Like she should be thanking me. Instead I get this, thats fine, I get to rape her via the law.

I don't know what it is like in sri lanka, but this 'merica and over here we have something called pants. White men have exclusive rights as to who wears the pants. We use those rights to keep 'merican standard as the standard and put foreigners in their place!

You should always take (real NOT Digital) Photos of an APT when you move in and when you move out. You should also make a list of damages when you move in (have the land lord sign it and date it in their writing) and then you should do the same when you move out. In any case, if your part of cali is anything like the city I live in then the burden of proof falls on the landlords side. Take that bitch to court. Most times they end up having to pay your ass. Courts love to fuck over landlords, more so than tenants.

If I was in another country I would do my best to be courteous to its inhabitants, not treat them like shit..
