Republican house members depend on small doner money and Trump is vacuuming it all up only to be disqualified anyway, if he does win the nomination, that's aside from being in prison until he dies by election day.

Here’s the relevant section. Note last sentence, though chances of that occurring are infinitesimal.

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
Uh guys, English class was not my best but the first highlighted part says no person shall hold office if they engaged in rebellion. The last sentence says that this "disability" can be removed with 2/3 vote of both houses. The disability disqualifies a person from doing something, such as missing a leg disqualifies you from being a fireman. But if congress votes to remove the disability the person can go on to be a fireman.

On the SS and jail time, the purpose of the detail is to protect a past president from harm. How would you protect someone in a prison? In other countries they set up a secure wing for the politician. As long as the ex is secure it does not have to be SS or guards although the quality of guards might be an issue in some jails.

His having engaged in rebellion needs to be rendered official, doesn’t it? Until then he is merely suspected/alleged to etc.

Seems to me that requires either a conviction or perhaps a statement by Scotus.

If I’m wrong, I’ll be grateful for contradictory established law.

The Constitution is clear and functions as the established law. I feel I can assume you read the opinion of the two Federalist members.

So precedence is currently being established (hopefully). There will be no court or case law until action is taken and challenged.

The way I look at it the only question is if Trump is disqualified from the republican primaries too, or just for running for POTUS and then only after he files the papers in the states. It will end up in court, a secretary of state will keep Trump off the ballot, but he can't sue to get back on, voters can sue a secretary of state to keep him off the ballot too. It takes a 2/3 majority in both houses to get him back on the ballot and not even the SCOTUS can get him back on the way I read it. If he can run in the republican primaries and they nominate him, they will in effect concede the election to Biden with a disqualified candidate. Donald will most likely be in jail or prison by election day and largely muzzled after a huge public trial and conviction in DC over J6.

If the Constitution were clear, we wouldn’t have one Scotus dismantling another Scotus’s accomplishments.

Like the Bible, the Constitution is made of prose text, which suffers from a breadth of interpretation. Our appellate courts, deliberating on legislation and prosecution, serve as the reducers of text to policy afaik.
