I'm thinking this is just a ruse by the FEDs to let Obammy show a little movement, and clout, on his promises, and to get a little press and airtime from the media. Because the tomatoes crossed State lines they fell under Federal Interstate Commerce laws. Another example of some faceless unelected bureaucrat deciding/defining law is the case of Gibson guitars. Gibson was raided, twice, because of a bureaucrat's interpretation of foreign laws. The Lacey Act states that any imported goods have to comply with all laws of the nation the goods come from. U.S. bureaucrats interpret foreign law, not judges or lawmakers of a foreign nation. In November 2009, federal agents seized guitars and fingerboard blanks that were allegedly made from illegally harvested Madagascan rosewood and ebony.
The reason the wood was deemed illegal was the government had been replaced in a coup and the new government was not recognized and some bureaucrat deemed that made doing business as usual, Gibson purchasing the same wood from the same foreign suppliers as in the past, was illegal.
In the latest FBI raid on Gibson FBI agents seized several pallets of wood, electronic files and guitars. The raid was justified by the FBI simply because the wood was finished in the United States. Indian law says no sawn wood can be exported, only finished wood can legally be exported. The Federal Department of Justice in Washington, D.C. has suggested that the use of wood from India that is not finished by Indian workers is illegal, not because of U.S. law, but because it is the Justice Department’s interpretation of a law in India.
All finished wood is, is wood that is supplied in standard sizes, not as in a finished/complete product that is made from the wood. Some bureaucrat decided that Indian law actually meant a finished product rather than finished wood.
The current administration said that for Gibson to use the wood they needed to outsource their production to India, to close down guitar production facilities in the U.S. and make their guitars in India instead.
That is the position of the Obama administration, an administration facing the worst unemployment problem since WWII, an administration whose main goal should be to help create a business environment that both saves jobs and creates new jobs, not use bullshit interpretations of foreign law, interpretations made by unelected bureaucrats and not by U.S. judges, Congress or foreign judges or the foreign government, to force U.S. businesses to fire workers and relocate to foreign nations.
Sadly some laws actually allow for interpretation and enforcement by unelected faceless ignorant bureaucrats. Because of that many things that are believed to be 100% legal, and should be 100% legal, can be deemed to be illegal if some moron bureaucrat decides it is illegal.
That sort of thing is what The Lacey Act was enacted to stop. But it was never intended to rely on faceless unelected bureaucrats interpreting foreign law to then use their opinion against a U.S. company. There is no interpretation needed when it comes to elephant tusks, and other things The Lacey Act was written to cover. The way the law is being used against Gibson is an abuse of the law. It is also an extremely stupid time to pick to abuse the law. With unemployment in the U.S. stuck at 9% and above almost the entire period of time Obama has been in the White House it makes no sense for the administration to tell a manufacturer to outsource jobs to India.
