Florida 569.0073 Pipe Ban Statutes, What Happened?

Ms Kitty is considering a move, she likes the sun and is tired of the indoor lamps if you know what I mean. I cant blame her, she's been at it for a few years. She seems to like Florida, while I'm pushing for California or Colorado. I'd like to run a glass store.


What's the deal with opening a glass botique in Florida?

569.0073 Special provisions; smoking pipes and smoking devices.—
(1) It is unlawful for any person to offer for sale at retail any of the items listed in subsection (2) unless such person:
(a) Has a retail tobacco products dealer permit under s. 569.003. The provisions of this chapter apply to any person that offers for retail sale any of the items listed in subsection (2); and
(b)1. Derives at least 75 percent of its annual gross revenues from the retail sale of cigarettes, cigars, and other tobacco products; or
2. Derives no more than 25 percent of its annual gross revenues from the retail sale of the items listed in subsection (2).
(2) The following smoking pipes and smoking devices are subject to the provisions of this section:
(a) Metal, wooden, acrylic, glass, stone, plastic, or ceramic smoking pipes, with or without screens, permanent screens, or punctured metal bowls.
(b) Water pipes.
(c) Carburetion tubes and devices.
(d) Chamber pipes.
(e) Carburetor pipes.
(f) Electric pipes.
(g) Air-driven pipes.
(h) Chillums.
(i) Bongs.
(j) Ice pipes or chillers.
(3) Any person who violates this section commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

That looks like I'd have to sell $750 in cigarettes for every $250 in glass I sold. I cant sell glass in Florida unless I also sell tobacco.

How are head shops there? Havent been that far south since I was 13.

I was thinking of starting a pipe company with some buddies of mine, down in Florida. I had never heard of this bill before, kinda crushed a little hope :/ Does this only affect in person sales however? Or would I be okay if the product was only distributed online?

The head shops are great down there, especially if you hit the college towns. Lots of traffic.

California is really nice! And you can sell a TON of glass in nor cal. It's like a trend here now, people love to spend 500$ on a piece of shit. You will do just fine selling glass. And the California weather is also really awesome!

yeah with one of the highest cost of living rates in the country, the highest taxes,earthquakes, forest fires,murders and on and on..

california is nothing more than a huge ass tourist trap run by douchebags lol

Thanks for the replies so far............ Not too much Glass love in FL! :( CA's taxes and traffic would drive me crazy. There are a lot more glassblowers there though!
 
Sell alot of blunts and papers? I know when i lived Florida there are a ton of head shops and the tobacco selection was very minimal in those. Traffic in Fl sucks also, probably not as bad as Ca. And Ca has high taxes but it's legal, Florida wont ever be there they way the state is operated a least not in my life

I think you just market them as 'tobacco pipes' and that circumvents the law. Also there is NO State income tax in Florida.

IDK there's shops that are focused on the glass but all of them have blunt wraps and apparel a few shop's have a Big ass rolling machines for making special blend ciggs, not to sure how much of the BS they really sell but i dont think there selling 3 times as much of it compared to the glass maybe they just do some magic with the books lol

Come to WA. The MMJ industry is getting bigger every year...only downside is the weather. Cloudy and rainy almost 9 months of the year....
