I'm not sure what the marijuana laws are in your state, but try and tell the judge that you need medical marijuana for whatever illness or pain you may have. He may also go easy on you if you do not have a previous criminal record.

i woulda shot em with my bb gun when they walked in my house. Thats why i don't leave the door open, ever again that is. I've had a brave/dumb piggy just walk in my house one time. My neighbor called po-po cuz the music was loud at like 1 in the afternoon. Pig just walked in (like 6 hours later at 7pm) and he claimed the door was open (Bull it was closed but unlocked), anyways, I hate cops. Keep ur doors locked, so the cops cant walk right in.

They need a warrant specifically to look for Marijuana in your house. Them taking anything from your house IS COMPLETELY ILLEGAL, I would go down to the station and demand that my property be returned to me.

Even if they have a warrant to search your house for guns, and they find only marijuana......they have to go back and get a separate warrant to search the house for marijuana. You shouldn't even be going to court, or have any charges brought up against you. What they did was completely illegal, 4th amendment....illegal search and seizure took place at your residence. I would be outraged

and unless they witnessed you shooting a animal, they have no proof.

true story: cops were sitting on a apartment they thought had a grow inside. all the tell tale signs, air conditioners whizzing all day, windows blocked out, never open, the guy went to the house during the day, almost never slept over... etc etc etc...
one day they see the "suspect" walk out with a bag, hand it to a guy in a scooter-motorcycle, and they decide to intercept. they thought that bag had the pot they needed to gain entry into the apt. the scooter shot off into traffic, the guy runs, and enters his neighbors apartment. the cops don't see him cuz it was around the corner (they've seen him enter the suspect apartment), and they break the door down and find the grow inside, like 100+ plants, several lbs of dry weed, small amounts of cocaine, and 50,000 dollars cash... the case has to be thrown out because they didn't have enough evidence to go into the apartment... the guy says he ran because he had to pee, and lawyers up.... he's given his lights, money, and hydro system back, with an apology from the justice system...
last I heard the cops got a heavy reprimand from the chief of police because they wasted 3 weeks of time, money, resources, to fuck up the investigation....

next time you shut up and find a lawyer, NRML.org, look up lawyers in your area and keep the number on speed dial on your phone, or write it down and keep it on you at all times.

even if you have done nothing wrong, if the police want to "ask you some questions" tell them no. they'll start saying things like obstruction of justice, mistakes, nothing to hide, blah blah blah... NO. fuck the police.... and if they keep fucking with you tell them you won't talk without a lawyer.

yea I didnt say word literally until said do you have your bond, and I have a pretty awesome lawyer he takes other payment he a Berkley graduate if you catch my swing son . and the judge from what I hear is really tight with carol mosely braun she was for the legalization ten years ago so I hope it fairs well I really didnt say a word just gave my wallet and asked for my att.

Dude basically that same bullshit happened to me I was soo fucking pissed. I got let off so you should to but its still BS. Usually with ilegal search and seizure they give ur stuff back. i actually did ask and the judge just laughed. either way though i can completly understand ur frustration. i know this isnt the easiest of solutions but if your really worried about heat you can move a to the next county over

this is tough, however they did come into your house without a warrent, ask your lawyer about a motion to suppress that is a motion that questions how they got the information, do that and your good to go.

from someone that has been around the block with the gun issue the police do not need the search warrant if someone called in a shooting to that address be it animal or human the same applies for chasing a dangerous felon he can run right into your house and they can follow i dont care if its your brother or mother..the only thing they are going to say is they did not know the weapon was a bb gun..but the good news is you can breath now lol they can not remove anything not related to the complaint from your home do you know they have to wait there and get a warrant for the new crime and then go in and remove said violation..so your good this time but be careful brother until we win this war on lealization.

well its been a while since this post was address and the particulars are ok ,not great but ok the state offered me a small fine(700) anda year of court supervision which is do-able , there is some humor to this though the judge asked me why I lived in this state where it is illegal, when the smart thing to do is move somewhere that its not so Im moving to cali in the next few months.
can anyone tell me if I can become a caregiver with a misdemeanor cultivation chargeon my rap sheet ??

as long as a legal patient goes through the legal procedures to assign you as there primary caregiver you will then only be restricted to your citiys' medical marijuana laws (total number of plants and dry weight are sometimes restricted depending on where you live)

Im moving to oakland , I have plenty of good friends there and I think I have a chance of getting a pretty good job, and another thing I hear oakland has a pretty big number of plants
