I have just transplanted to a bigger pot could this be why then? Its only the first node leaves that r drooping down and touching the soil , the rest r branching out or stretching up.

What he said, next time dont transplant until you see roots coming out of the bottom of the pot or see them starting to surface on the very edge of the soil and the pot.

but the good news is that with a fantastic root system you are going to have a great yield. Like I said lessor of two evils. Guys do this to conserve height. Some people dont have a large area to grow so they let the roots grow and when the plant is the size of a basket ball they put in flower, they get about two foot of vertical growth in the first two weeks of flower and the yield is thick and good due to the established root system. You will be fine
 
most of the time i am setting the plant about an inch deeper into the bigger pot, i need to trim off the 2 lowest branches and leaves anyway. if i dont have to trim them right away, i will have to at some point do to a little nute splash from watering. no matter how hard i try to hold the leaf up and water under it, it gets a little splash here and there.

and they do die off anyway as said above.
 
thanks for the advice guys :) , how long after transplant should she settle and start to grow upwards again?
