thanks man yeah gonna have hands full for real i'm gonna start two or three outdoor grows as soon as weather gets better spring and fall harvest outside this year! getting a tent sometime next month too so i can breed for more seed soon. I hope to god that this shit gets legalized this november. If your in cali go fucking vote no excuses register now if you have to!

No more medical plant / posession limits in california!!!!! California supreme court just ruled on people v kelly challenging sb420 and ruled in kelly's favor (medical patient) and we fucking won we fucking won whooooo i can have grow as much as i want/ need with no fear of jail whatsoever

California Supreme Court Strikes Limits for Medical Marijuana Patients

Exemption from arrest and prosecution upheld for state-issued ID cardholders


SAN FRANCISCO - January 21 - The California Supreme Court issued a unanimous published decision today in People v. Kelly, striking down what it considered unconstitutional legislative limits on how much medical marijuana patients can possess and cultivate. Today's decision also affirms protection from arrest and prosecution for patients who both possess a state-issued identification card and comply with state or local personal use guidelines.
"The California Supreme Court did the right thing by abolishing limits on medical marijuana possession and cultivation," said Joe Elford, Chief Counsel with Americans for Safe Access, the country's largest medical marijuana advocacy group. "At the same time, the Court may have left too much discretion to law enforcement in deciding what are reasonable amounts of medicine for patients to possess and cultivate."
Although the court affirmed that qualified patients and their primary caregivers retain "all the rights afforded by the CUA [Compassionate Use Act of 1996]," law enforcement can still arrest and prosecute if probable cause exists. In keeping with the CUA, qualified patients and their primary caregivers will still have an affirmative defense in court. Advocates remain concerned that without guidance on personal use amounts, police may abuse their discretion to arrest patients who are in compliance with the law.
The defendant, Patrick Kelly, is a qualified medical marijuana patient treating a number of conditions, including hepatitis C, chronic back pain, and cirrhosis. Kelly was arrested in October of 2005 for possessing 12 ounces and cultivating 7 plants at his home in Lakewood, California. Kelly was convicted a year later by a jury, which concluded that he had exceeded the state-imposed "limits" of 8 ounces of dried medical marijuana and six mature plants. California's Second Appellate District Court overturned Kelly's conviction on the grounds that legislatively-imposed limits on possession and cultivation of medical marijuana are an unconstitutional restriction to a voter approved initiative (Proposition 215, the Compassionate Use Act of 1996).
Both parties in the case, Kelly and the State Attorney General, agreed that medical marijuana limits should be abolished as unconstitutional. Both parties also opposed the appellate court's invalidation of the entire statute, Health & Safety Code Section 11362.77, which protects ID cardholders from arrest and prosecution if they are in compliance with local or state guidelines.

i wish my recommendation said anything bout more plants!! i need to get that fixed. my county(tehama) has banned outdoor growing. they tried banning indoor. in other words fuck tehama county

dogg read the wording it says basically that its a peoples law so only the people can ammend it so the county city no one but the voters can write any law to limite possession or amounts of plants or any of it and that's the supreme court of california stating this so it can no longer be challenged

my script doesent specify i dont know of anyones whose does and i know over 10 peeps scripted FOR THE UPTEENTH TIME NO LIMITS

what you need is the exemption for numbers. if you eat your herb, you need a lot more than if you were to smoke it. right?... a lot more... your doctor can specify how many plants he thinks you need based on how much it takes to help your condition - tell your doc you need more. i make a lot of salves and edibles, so my doctor recomended limit is on the high side.

people why are you not getting this there are no limits anymore so it doesent matter what your doc says what jhonny law says what anyone says the highest court in the land says no limits keep up people come on now

mike - im not tryin to start a war, i mean no offense and i wont post anymore about this in your journal. i just dont want people to get busted for growing their medicine. the ca supreme court backed the decision that doctor-patient relationship is sacrosanct - untouchable. if youre growing within what your doctor recommends, youre good. if prosecution can prove that you are growing more is medically necessary, they can prosecute. this doesnt make it a free-for-all. iguess my point is that you should be on the same page as your doc, because he may go to court for you someday.

dogg ive been following this case for awhile before any of you even knew this was already the case and only had a chance of being overturned but wasnt ive been waiting on this decision since november of 09 n i dunno bout you but me and my doctor didnt discuss amount nor did any of the peeps i know with scripts no its not a free for all its going to be after this nov (full legalization on ballat) but if you can say you can smoke it or justify it somehow then you'll be just fine lets be real about this no you cant plant a field but you can damn sure have a yard full n not to be all on this im right you wrong tip but ive been arrested over 25 times (no longer count) since 18 n been convicted 0 i know what the law is and i know police police jump the gun all the time there is nothing to be done about that thats what the court is for i reapeat 0 convictions im not trying to be on some debate tip with you but i obviously understand this situation better than you so i win debate over peace lmfao
