Need serious credit advice (sorry for similar thread)

Long story short, i owe a creditcard 1400 bucks. They filed a suit against me and i have a court date. My options are, let them garnish my pay for a retarded amount a month, or pay 1000 in full and theyll clear my debt, or pay 160 a month until the 1400 is paid off. Now im broke, 1400 isnt alot, but it is when your in my shoes. So should i just pay the full 1000 or go to court and see what i can settle? I only have about 2 weeks to figure this out so any past experiences from anyone, help , ALOT

But I would just pay it off.. didnt u say u had enough with your tax return money? I would just pay it, get it over with and not have to deal with anymore BS.. I sure as hell wouldn't want them garnishing my paycheck!

i'd say chuck the paper they sent.

noone is going to court over 1400. call their bluff. Lawyers are charging them an assload to stay out of court. they will not go to court if you push them.

If you decide to go to court and you lose the CC Co will also
seek their court costs from you. The judge may order you to
pay your full bill plus the court costs. If they sent you a letter saying they will
take $1000 try to work them down more, tell them you can settle this today for 750.00
then go pay it if they accept.

If they agree to the deal, make sure it is not just a verbal agreement, have them fax you a new
settlement agreement for the new $750.00 arrangement. If you dont make sure it is on paper,
soon enough they will seek the rest of the balance.

Work with them, it is your only option to save yourself more money in the end.

Thanks peeps, yeah like i said in the title sorry for the similar post, That post made me think about my situation lol.. I realize that if they garnish my pay they HAVE to go to court reguardless to get permission. So im just going to go to court and tell the judge my situation and what i can settle for rite now. Who knows maybe it will get dismissed if my excuse is good enough, its only 1400 bucks!

You better make sure they can not collect court cost or attorney fees from you. I don't believe they can because it's small claim court, but then again I'm no lawyer. Our company in the past has to take the short end of the stick because the other people had way too much money to throw at their lawyers and then in the end they'll collect them back or your company goes BK.

Call a local attorney and just ask a quick question and I'm sure they'll answer it for you so you know what is the better choice.

The thing with a CC is that you spent the money. No excuse is good enough to enable you not to pay.

If I was in your situation I would try to settle with them for the least amount possible.
My wife was a collection agent, they can and will take you to court, and they will pursue all
costs incurred to get judgment against you and collect their money.

Just my opinion, take it as you wish.

I maxed out a CC at $10k and they threatened to bring me to court too. The guy I was working for bounced 2 checks on me and screwed me hard. I told the CC company my problem and I wanted to work with them but they demanded way too much for me to afford. So 7 years went by and I got some mail from them offering me a new card. I payed them $0 and have another platinum card from them. I have decent credit and paid off a few cars and such, it was just that 1 card and it only hurt my score for a couple years. Funny how credit works. Are they really bringing you to court or is the collection agency threatening you?

PS dont answer door to baliefs/debt collectors lol

There are a few companies which specialize in defending their clients against wage garnishment to pay credit related debts. In your case, it might cost you less than $1000 to settle the debt if it's owed to only one lender.

Check out your local bankruptcy attorneys and see what they can help you out with. Usually these guys are trained to deal with wage garnishment defense in addition to everything else.

Good luck mate. If it comes down to it though, just pay the $1000 if you can manage it. But don't settle for a monthly plan if you can't guarantee you'll be able to stick with it. In that case, get an attorney.

offer to pay them half in a few installments, like three. They do that all the time. Best you can do. Or 40 percent all at once.

Again thanks for all the replys. I spoke to the collection agency's attourney. They refuse to accept what i can seriously afford. Basically after an hour on the phone it ended like this " if you dont give us what we want well just garnish your pay. So if they want to do that they have to go to court to get permission. So im going to follow through and respond and get a court date and try to work something out that way. The "court" papers they sent me are just basically a scare tactic (from what ive researched). Its not complete BS but basically there threatening to take me to court and since we cant come to a reasonable agreement i think im just going to have to go with it
 
they actually go to court all the time in the hopes that you don't show up, which most people don't. I was in the exact same boat twice, the first time i didn't go to court and they garnished my wages , but they didn't garnish my wages till like 3 years later. And my case they did charge me the court fees too which is actually an additional debt as well. the second time i settled before court, i would recommend that if you can, see if you can settle and make a deal before then, at least agree to something to avoid court. They usually will take crap monthly payments if you agree to it.

is it a collection agency? They wont go to court. Just keep dicking with them the lowest number you can. 40-50 percent somehow in payment is ok the parent company is telling the credit agency. Some companues set lows of 40 some 45 some 50 blah and just find that and make a several payment deal. they will lie to you and yell at you and try to scare you. Tell them to cut the crap and tell you the lowest number cuz that is all they can get ever from you. They want their comission and more often than naught they get nothing. Tell them to put their supervisor on and offer them the lowest. They wil take that. Unless, sorry, it is past that and the lowes is too much in payments. Then try sending a good faith payment maybe to stall. If it is the credit company and naught a collection agency then idk it might take some more time and then it will got to a collection agency. They rarely get to court.

Also if it has been over 2 years do not give them shit. Do not answer their calls. Do not acknowledge them. If you pay them after this point it will bring down your credit score. If you are trying to get a mortgage they recommend not paying it til closing because it will mess up your credit rating and interest.
