Im fine and understand the breathalizer, but needles suck. Yet another reason I am happy to not live in Texas.

If a person causes harm to another and they were intoxicated they are guilty of an actual crime.

If a person, not weaving and by all outward appearances driving safely is stopped at a DWI "show me your papers" circus and then found to be legally intoxicated by blood alcohol content they have committed no crime against anyone. I am more concerned about the abilty of the Police to set up roadblocks
and stop anyone they want. This can only get worse.

The road block situation is interesting. I actually called the Sheriff's Department on this after my daughter was stopped at one. I asked the deputy how they squared the road blocks with the Fourth Amendment. Here's what he said: "This issue went all the way to the Supreme Court. The court ruled that as long as the police post a sign in advance of the road block, telling motorists that a road block is ahead, and the motorist continues on, the sign is constructive notice, and that means the motorist has volunteered to waive his/her Fourth Amendment rights. The motorist has the option of turning around in order to avoid the check point, and thereby not volunteering to be searched." I said ... "But the road block was set up on Malibu Canyon Road, half way to the beach. If one were to turn around at that point, one would have to drive miles out of one's way to get where one was going." The deputy said ... "Well yeah, but that's not our problem."

Go figure.

This new idiotic law will be overturned in court. And since I live in Texas I'm happy you aren't here either. I thought you left or was that a Brett Favre I'm leaving thing? We've got enough flip floppers as it is with the biggest being Gov Perry.

People seemed fine with me coming on so decided I would post things from time to time. I never left the site, just this board because I felt like I was being told that I was not able to post what I wanted to.

But it is good that we are all happy.

it is really sad what is happening 2 this country.
a little at a time, and no one will notice.
scaring people and manipulating them into passing laws that they (we) do not understand.
