I sent an email to medical@ocm.ny.gov asking if they can clarify the civil or legal penalties for over plant limits. I’ll reply here if I hear anything.
The only issue I have if you are trying to do everything by the books is with mother plants and cuttings. We all know that not every cutting always takes so you’re going to have more than 6 veg if you grow 6 and have mothers to produce your cuttings.
Also I assume cbd plants will count towards your limit even though there is less than 1% of thc - I can’t see them testing them.

What surprised me is that female plants only count twoards the 3 & 3. So by this logic I am assuming that one can have more pre-sex seedlings than the 3 immature limit.

Most of it is easy to understand, and although I'm looking for more info on being a caregiver, I'm most of all searching for current laws relating to growing over the 6/12 plant limit. All I can find is info on NORML website. I think one of you was saying it was a Civil penalty, with a fine attached to it. NORML says misdemeanor and up to1 year in jail. It would be fantastic to sort this out once and for all...

Websites have misinformation, I only try to pay attention to the Government websites. Section 222.25 and 222.30 explain the penalty for possession.

edit: sorry I thought you were also asking about the possession law as well as the plant count, but this example at least shows how that website you shared has false information, basically they're showing all of the old penalties on that site..

edit #2: Section 222.15 paragraph 6 subsection A lists the maximum penalty for a violation of any regulation. But keep in mind if you harvest over 5 lbs you are going to fall into whatever the possession laws are for that amount which is felony territory.
