Obama Not Implicated In California Medical Marijuana Crackdown, U.S. Attorney Claims

This story tells us that after the damage is done now the blame is looking for a home.

WASHINGTON -- U.S. attorneys have a message for California's medical marijuana advocates: Don't blame Barack Obama. After it was announced that the crackdown on medical pot establishments in the Golden State was a collective decision by the four U.S. attorneys in California and not the result of any directive from Washington, spokeswoman Lauren Horwood emphasized that the administration never even green-lighted the ramped-up enforcement actions.
The only D.C.-based official with whom California U.S. attorneys coordinated, Horwood said, was Deputy Attorney General James Cole, who was chosen by Attorney General Eric Holder, an Obama appointee.
"He's the one who provided the quote for our press release, and he's chosen by Eric Holder," Horwood told HuffPost in an interview. "But we didn't have direct talks with Eric Holder -- not that we wouldn't, he's been out and visited -- but just the way the Department of Justice works, he's not that hands-on on these kinds of details."

...

When asked to respond to the claim that the Obama administration isn't implicated in the decision, Ammiano was indignant.
"Somebody's going to have to fall on their sword about this," he said. "This is becoming more of a mainstream issue. I mean, this was really a mistake."

It's not clear what effect this crack down will have on the industry. I have to wait and see who is left standing and where.

This comes after Gov. Brown vetoed the dispensaries near neighbourhoods bill.

So it may be punishment for that also.

the guy came out of nowhere and in a few years, he will be gone, only remembered for being the first "black" president.

with his own little obama museum somewhere and doing campus talks for a few mills a talk (he´s probably gonna ride that black president gravy train for the rest of his life (nobel winner and all)

but there is no accounting.

on the surface, being a president is basically being a boss

basically

"shut the fuck up and do what you are told ;)"

thats what we hire these people for ;)

bossing us around.

Im also waiting to see. I currently am way involved with mmj dispensaries in CA.
This looks like the bush era holdovers having their way with mmj because they know obummer's hands are tied right now as he is constantly in re-election mode.

Medical pot backers' suit seeks end of U.S. raids, threats
In suing U.S. Atty. Gen. Eric Holder and the top federal prosecutor in Northern California, Americans for Safe Access accuses the Obama administration of using coercive tactics to interfere with powers delegated to the states.
October 29, 2011|By John Hoeffel, Los Angeles Times
Medical marijuana advocates want a federal court to halt the recent raids and threats of prosecution that have significantly stepped up the Obama administration's assault on dispensaries and growers.

Americans for Safe Access, an advocacy group based in Oakland, has sued U.S. Atty. Gen. Eric Holder and Melinda Haag, the top federal prosecutor in Northern California, accusing them of violating the Constitution's 10th Amendment by using coercive tactics to interfere with powers delegated to the states.

The four U.S. attorneys in California have dramatically ramped up efforts to shut down medical marijuana operations and have advised cities and counties that they cannot adopt regulations that effectively authorize the distribution of the federally controlled substance.

"They're not just enforcing marijuana laws, they are doing something extremely unusual in an effort to quash the medical marijuana programs in the various states," said Joe Elford, chief counsel for Americans for Safe Access. "They're not allowed to commandeer the lawmaking functions of the state."

Thom Mrozek, a spokesman for the Department of Justice, declined to comment.

The 17-page lawsuit filed Thursday in U.S. District Court in San Francisco takes aim at a critical issue that remains unsettled even though California voters approved medical marijuana in a ground-breaking initiative in 1996. Because marijuana remains illegal for all uses under federal law, municipalities and states have struggled with how to regulate it for medical use.

Federal prosecutors in California have warned some cities against approving ordinances that authorize marijuana cultivation and distribution, such as licensing or issuing permits to dispensaries. A recent California appellate court ruling reached the same conclusion, but other appellate courts in the state have instead ruled that federal law does not trump state medical marijuana laws.

"The federal government has instituted a policy to dismantle the medical marijuana laws of the state of California and to coerce its municipalities to pass bans on medical marijuana dispensaries," the lawsuit says. "To this end, the government has pursued an increasingly punitive strategy, which has involved criminal prosecutions of medical marijuana providers with Draconian penalties and letters threatening local officials if they implement state law."

The lawsuit cites several recent examples of U.S. attorneys telling cities that officials could face federal prosecution. It notes that Chico voted to rescind its recently adopted ordinance after a federal prosecutor met with the city attorney, city manager and police chief. City officials in Eureka received a letter saying that their plan to license large-scale cultivation violates federal law. And a federal prosecutor's warning to Arcata officials led them to suspend medical marijuana dispensary permits.

Federal agents this month also raided a collective in Mendocino County that has cooperated with a program to regulate growers, cutting down 99 plants. The lawsuit notes that Mark Perillo Sr., a 48-year-old member of the collective who suffers chronic pain from a degenerative joint disease, was deprived of his share of the harvest.

"He will be impeded from obtaining his medicine because no other delivery service provides medical marijuana at the same low cost," the suit says.

Last week, California Atty. Gen. Kamala Harris warned: "An overly broad federal enforcement campaign will make it more difficult for legitimate patients to access physician-recommended medicine in California. I urge the federal authorities in the state to adhere to the United States Department of Justice's stated policy and focus their enforcement efforts on 'significant traffickers of illegal drugs.'"

I hate to say it but he doesn't have to do shit... NOT that I agree with it... but lets face it The government lies, they always have, always will, big brother can NEVER be trusted to keep its word... Obama like every other politician, Republican, Democrat, Independent, Tea Party, Etc are lying pricks. The only way to hold a politician responsible is to NOT re-elect them... but then you have to look at the lesser of 2-3 evils as I repeat all politicians are lying, stealing, dishonest pricks EVERY ONE!

Now I think Obama should have to answer the question, WHY! WHY did you so blatantly lie to the American Public.

I don't live in a Medical State and honestly mine will be one of the last, but this is still important to everyone that uses cannabis.

My question is why can't we get some senators and reps that are not "over the hill, through the forest and 1 foot and 2 hands in the grave", The biggest reason we wont see change IMO is that the people we have representing us were alive when hemp/cannabis was banned!!! obviously its an exaggeration but still you get my point

do good men, ever want or seek out power over others?

i dont think so.

i dont think any man worthy of power, has the slightest inclination towards getting power.

people´s time in office is limited, supposedly to halt corruption, but i think any man in office, was thoroughly corrupt way before getting there.

I am not so sure the Federal Raid is unbiased.

What seems to be the most important is to see who gets hit and who doesn't

So far Long Beach has been given a pass.
Who else is being picked to be standing after this "Crack" "Down"

If I have to name what the political context is; I will say it is the Ostrich in the sand.

I have a good impression that the Central Valley is more concerned with keeping their illegal workers than anything else.. They seem to want to know that fighting the "Drug War" is over and that "Sex Offenders" are some how sent to death and if these things are true then control of their local schools is important but Medical Marijuana? It's supposed to be defeated.. Right...

Now do we hate Obama and embrace Romney? Think about it.. Romney is trying to be centrist coming from the far right..
Obama is a centrist that has to deal with the left.

I state strongly that those of us who make good money with weed are our enemy too.

So if you have to sleep with a devil and service that devil do you want to wake up with a Republican or a Democrate?

Anyway I am fresh off a live interaction with my representative and he declined to address my Medical Marijuana question. That is why I am political at the moment.
