Medical marijuana advocates want a federal court to halt the recent raids and threats of prosecution that have significantly stepped up the Obama administration's assault on dispensaries and growers.

Americans for Safe Access, an advocacy group based in Oakland, has sued U.S. Atty. Gen. Eric Holder and Melinda Haag, the top federal prosecutor in Northern California, accusing them of violating the Constitution's 10th Amendment by using coercive tactics to interfere with powers delegated to the states.

The four U.S. attorneys in California have dramatically ramped up efforts to shut down medical marijuana operations and have advised cities and counties that they cannot adopt regulations that effectively authorize the distribution of the federally controlled substance.

"They're not just enforcing marijuana laws, they are doing something extremely unusual in an effort to quash the medical marijuana programs in the various states," said Joe Elford, chief counsel for Americans for Safe Access. "They're not allowed to commandeer the lawmaking functions of the state."

Thom Mrozek, a spokesman for the Department of Justice, declined to comment.

The 17-page lawsuit filed Thursday in U.S. District Court in San Francisco takes aim at a critical issue that remains unsettled even though California voters approved medical marijuana in a ground-breaking initiative in 1996. Because marijuana remains illegal for all uses under federal law, municipalities and states have struggled with how to regulate it for medical use.

Federal prosecutors in California have warned some cities against approving ordinances that authorize marijuana cultivation and distribution, such as licensing or issuing permits to dispensaries. A recent California appellate court ruling reached the same conclusion, but other appellate courts in the state have instead ruled that federal law does not trump state medical marijuana laws.

"The federal government has instituted a policy to dismantle the medical marijuana laws of the state of California and to coerce its municipalities to pass bans on medical marijuana dispensaries," the lawsuit says. "To this end, the government has pursued an increasingly punitive strategy, which has involved criminal prosecutions of medical marijuana providers with Draconian penalties and letters threatening local officials if they implement state law."

The lawsuit cites several recent examples of U.S. attorneys telling cities that officials could face federal prosecution. It notes that Chico voted to rescind its recently adopted ordinance after a federal prosecutor met with the city attorney, city manager and police chief. City officials in Eureka received a letter saying that their plan to license large-scale cultivation violates federal law. And a federal prosecutor's warning to Arcata officials led them to suspend medical marijuana dispensary permits.

Federal agents this month also raided a collective in Mendocino County that has cooperated with a program to regulate growers, cutting down 99 plants. The lawsuit notes that Mark Perillo Sr., a 48-year-old member of the collective who suffers chronic pain from a degenerative joint disease, was deprived of his share of the harvest.

"He will be impeded from obtaining his medicine because no other delivery service provides medical marijuana at the same low cost," the suit says.

Last week, California Atty. Gen. Kamala Harris warned: "An overly broad federal enforcement campaign will make it more difficult for legitimate patients to access physician-recommended medicine in California. I urge the federal authorities in the state to adhere to the United States Department of Justice's stated policy and focus their enforcement efforts on 'significant traffickers of illegal drugs.'"
That we suffer (ordinary people) the slings and arrows of not only the oppressive governmental forces we are at the mercy of the cannabis suppliers is yet more dysfunction to realize. I state that we must fear both the Legal and the Financial aspect of Cannabis oppression for all of us.
That both Cannabis industry and Federal Government strive to keep cannabis prices high suggests that illegal or not it is a regulated industry.

That we as a whole cannot be a comminity in the light of the rift between the "weed factions" is the sad sad, reality of our current situation.

I have asked if we as a community are trying to legalize the Green of the plant or the Green of the cash. That is still a valid and open question.

I see some good information in this thread but also alot of dis-information.

Obama made several campaign statements but never made any *promise* that he would not continue the status quo of raids, et al. He said exactly what the younger generation (who were naive enough to believe him) wanted to hear. Here's some of his campaign talks while on the road (with dates, references for those with short term memory problems).

Now for those of you who think his 'Drug Czar' is the culprit, you are dead wrong. Obama directly appointed Bush-era holdover Michele Leonhart as the new head of the DEA. A worse choice he could not have made.

A perfect example of Obamas reasons for picking her could not be more clear than the recent senate sub committee hearings in which she was publically thrashed by Senators Cohen(D) of TN and Jared Polis (D) CO. Leonhart is the perfect example of why this country is beyond 'Hope' or 'Change'. A more inept, ignorant or bumbling person does not exist. But she does have over 32 years of law-enforcement experience and that's exactly what he wanted...someone who would continue to enforce federal law!

I STRONGLY encourage everyone to watch these two short videos and prepare to be outraged. This is someone with a 2 billion dollar+ budget that should NOT be in a position of power. I wouldn't trust her with a potato gun, and he put her in charge of the DEA!

I see that in California we must drop all commerce language and all of us support Civil Rights to grow, consume and in non-commercial ways share marijuana/cannabis.
This means we are not fighting for decriminalization anymore we must go all the way to legalize it for the people.
Once that brick in the wall has been removed then watch as all the other bricks have no support.

Again it is time to drop the decriminalization as a goal. We must swing hard towards freedom and realize that whatever we do it will be limited by laws so do not compromise before you get rights or realize that the compromise will be reduced to it's least effective form.

This link is to a well written article on the current state of affairs and I agree it is time for our President to speak on the issue.

As president we need to understand and as a Candidate I want a solid commitment to one position.
You must have missed it. He explained it. His explanation was, "Ha ha ha ha ha ha ha, stops to wipe eyes, then proceeds, ha ha ha ha ha ha"

Ernst, I agree that decriminalization is a bad end goal and that legalization is the only way to end the bad effects of the drug war, but I don't understand your "drop all commerce language" point. Would you elaborate please?

it would be cool if the argument for legalization didn't lean on the point that the top dogs have profits to be earned.. the fight has always been for the individual freedoms of people to consume a safe, beneficial plant and i would always want our victory to reflect that - not that we simply all caved in the end to the profit margin..

Not Really since YOU and all of US are more important to Democracy than political President or Political legislature of any State.

Now if the point is to defeate me then take all your impus as gratification and enjoy that moment of solice. .

Yes.. Our efforts to "Fit In" is contrary to revolution of self and since a war of Marijuana (drugs) is Nixon's legacy and those who feel for Nixon's salvage is the least of his evil as a tribute then we must stand together as thosewho Nixon wished to defeat in the age of Vietnam have passed the Torch!

Those seeking "Higher" existence and freedom from the slavery of commerce should be free to grow a plant!.

Cannabis is a plant that grows in the sun (free) it requires no manufacturing context. That is the Achilles heal to the American Capitalism concept.. When it comes to controlled substance.
No other "controlled substance" requires no refining.

If GOD wished us to have a good time without processing then Cannabis is it!

But isn''t cannabis about a private life of dreams more than a public one?

i am not so concerned now with the money end of things. i was in the doc for my script the other day and it was a line of people each of them handing over $195.. not really a happy go lucky time..
what i am very interested in now still is the industrial uses of cannabis - it really can make gasoline - this is a fact - it makes proteinous food, building material stronger than steel! we need to got off of petroleum and this is a way to actually do it - last i heard 1 acre of hemp makes 500 gallons of 'hempoline' - an oil very similar to gasoline.

these are things that our president probably knows - you all saw how much weed he smoked in school right?
back on topic - i think that this is an election year and he won't muddy the waters at this point - but, wait and see - i have some faith that Obama can work for us on this whole thing either behind the scenes or as a final righteous move before he leaves office in the next 4 years. he doesn't need to risk losing to a dog kicking mormon.. :p

Look at the worthless person that he made Drug Czar....Now it is no longer on Obama,,,,Check out the Drug Czar,,,he didn't have a job until President Obama hired him,,,,,he should be fired after this term,,,,,he has done nothing pro,,,He made MJ a type 1 drug which is a load...MJ is hardly a harmful drug..
