So we've got somewhat convoluted legal sales now in Ohio, and prices have begun to come down from the stratosphere. Little has been done, unfortunately, to address the social equity aspects of the law we citizens passed, and the regulatory hoops to jump through and costs associated with opening a dispensary or grow operation are still prohibitive for every day people. More dispensaries are in the works, which is good for consumers, but they are largely operated by big companies, some of them based outside of the state. I do not know how grow licenses are being allocated, or whether more are even being issued at this point. I would love to be involved in a small grow operation, or maybe even as a retailer, and I do have some (limited) startup capital, but the red tape is daunting, not to mention the general business requirements. Does anyone have any insight into what is required now to get up and running, as far as state fees?
Our home grow situation is also a bit murky to me, and detailed information about exactly what is legal and what is not are sparse. Are clones/seedlings a component of your plant count? There is no distinction in the law between vegetative and flowering plants AFAIK. And I presume that selling them is not permissible, but can you transfer them to friends as a gift, without renumeration? Could you claim your non-THC producing plants are Farm Bill compliant hemp, and get away with that? (RIP 2018 Farm Bill in 2025 - the GOP will close what they consider to be loopholes, and mess up more than that.)
I have so many questions that no politician or bureaucrat is going to be willing or able to answer, and there is virtually no legal precedent yet, so any knowledge or opinion is appreciated. A lot of the details of legalization were left to the Division of Cannabis Control, but I've heard little about their implementation lately.
