Probation ..Courts

Hi everyone.. I have some issues and was wondering if anyone could help..

So I've been on Formal probation for the past year, 2 more to go... not for a drug case or mj obviously.. and just recently the courts ordered me to start random drug testing. So of course being the stoner that I am I got my mm card. well just my referal. With the referal my Probation officer was letting me smoke at first.. then i got a new PO and he made me go and just clear it with the courts. I had this asshole judge, not my usual judge and he said it was a "scam" and an excuse to smoke pot. Im bi-polar and I use my canabis for my depression and insomnia. He said there are other medications to treat this. I didnt have my lawyer with me I had the "public pretender", who insisted that it should be no problem before we went in there..:shock:

So I'm wondering if anyone has experince with this and if I get the county card which is coming in the mail soon and my lawyers present when i go back to court for my probation check up I'll be able to get these stipulations changed. I wasn't even able to speak on the matter. Any help would be appreciated. thanks guys.

they have to respect state law. fuck them bitches!!!!! the judge has to go by that states law not his oppinions. keep smoking. if they lock you up or violate you or make you take drug classes take it to the supreame court, and if you win file a lawsuit on them bitches!!!!!!!!!!!

In florida and california you can not smoke while on probation, they make you sign a form stating you will not do soo even if you have a card

but if u had the refleral befor simply tell the judge he isnt a doctor so his medical opinon is irrelavent your doctor says its ok and the judge must respect the law

exactly!!!!! i know they make you sign a paper saying you will abide by terms of probation or take the jail time. but they have to respect states law. i smell a lawsuit

no no no ok think of it this way. owning a firearm is legal unless you are on probation. get it. Even if something is legal if it is against the terms of your probation you cant do it period.
 
your fucked man :( the law aint on your side.. in fact most doctors recommendations even say somewhere in the fine print " void if patient is on probation or parole.. its fucked man i know but the courts have already decided that people on probation and parole have no right to mmj

No...they can't stop you from taking Medication...you are completely wrong.

And it wouldn't say you can not smoke...wouldn't you just eat it then?

OK I have no problem admitting when i am wrong soo with that in mind I pulled up my old probation paperwork and low n behold your right, remember though this is floridas department of correction rules not everyones. Its been forever since I read through the paperwork soo I guess i owe u greens on my next bowl....on another note I do have a friend in cali that is on probation for drug charges and she said you cant smoke if you have a card and your on probation for drug related offense. however i have no way of verifying this, attached is a picture or the florida probation terms

you could have a list of items on your side saying you can medicate and all they have to say is no and that the final answer

they system is full of fucks that dont care about people they just want your ass in the system so you create revenue for the system
not sure about every state but I bet its about the same for most medical states in the us but here in Oregon they got a thing just for this, check out #19

i dunno, that doesnt seem right. has no one thought to sue for it yet? they cant deny you medicine. they can try but it sound to me like someone needs to get a nice expensive laywer to take it into federal court or whatever. let me put it this way.....if i needed to take a pill everyday for my heart they couldnt tell me i cant, thats ridiculous, not saying your wrong, they probally think they can, but a good lawyer and a lawsuit should be able to stir up enough buzz to get it changed. i'd like to see them say in court medicine can be denied because of probation or parole and see how the talk shows would buzz on it for days.

Its not right !! at all, but I have seen the system enough that I know they some how can and will take your rights away
it does not make sense at all how they can take 1 kind of medicine away but not others but thats what they do
it would be nice for some one to hire a expensive laywer and fight for it but thats how it is wrote up in the state and there is probally no chance taking it to federal court sense they dont reconize medical marijuana at all

yeah, thats true. i was thinking about it at work last night and i realized its the federal courts that keep fucking with the legal med growers. at least they used too. i think obama has em backing off on that. maybe bring this up in one of his town hall meetings but then again the questions are all probally pre-screened if not outright pre-determined. dont get me wrong i like obama but thats how gov works

TheHighClub is simply wrong. Just read SB 420. You're covered, unless the court disagrees with you. I would hire a good MMJ lawyer. NORML.org has a website that list a bunch of lawyers. Otherwise I would make a good case, and you shouldn't have a problem. It states right in SB420, that you can medicate whilte on probation, if the courts modify your probation for it, otherwise you would not be able to.
