at some point in his ramblings he was saying that its still concidered highly illegal in the eyes of the federal government blablabla ...i said but you work for the county ...

i also asked at one point, you must feel bad knowing that my kids scared of police now and was totally shook up. nope not one bit he says. "you made the decision when you started in this business". what decision? to grow my own meds? your full of shit etc ..

You should've recorded this nonsense, and let him know it. His personal opinions regarding this matter have obviously come into play, and since he is a representative of the state, you most certainly have grounds to stand on when it comes to a lawsuit regarding this jackass' behavior in this area. He is not only superceding authority, and circumventing state law to satisfy his own means, but probably doing a million other illegal things. He needs to get called out, not just for you, but for everyone. Get an attorney, and start documenting this harassment right now with pictures of the van, etc.
It is complete harassment to have a van or any other kinds of this nonsense going on if they have no proof of you doing nothing, but growing your own meds.
The LEO's are blowing smoke if they tell you that they can't check the number on your MMP card with your name. I talked to someone in Lansing months ago about this very matter.

we dont. the guy sat out front for bout 30 ish minutes. he got in and out of the van a couple times and stood near the door talking on walkie talkie.

i simply wanted him to, next time he decides to narc on someone to put some effort towards finding out if they are medical. he said no chance in hell thats the chance we take. lol

Well, I knew it was coming. Dont we all? Today my kid stayed home from school and he was laying, sick, watching some cartoons when a gang of police entered with a search warrant. They were extremely nice, they were not interested in catching me on little things that I believe they could have got me for. They took my info and then we counted my plants while a masked officer searched a few cabinets and bedrooms. While I was answering a couple questions with an officer, the masked officer was scrolling through rollitup on my computer, I had it opened to a Michigan thread. He commented on a few pictures he seen (and KB's "Fuck The Police" avatar LOL) and they were on their way. I walked them out and one cop said "ill be back in two weeks to make sure you put a door on that grow room". This is Oakland County/Hazel Park.
I was narced on by the water department, they came over on a service call last week cause my pipes froze and it was obvious to him i guess with the smell and the plants vegging under a t-5 in my laundry room. LOL
One officer mentioned that they wouldnt do these raids on medical if they were allowed to simply call the mmmp and get info on patients/caregivers. since the confidentiality rule there is no way of them finding out if were legal without coming in to see with their own eyes.

Yes,it sucks to be the one "inspected'...it's an inconvenience and hassle.

But that is the usual outcome when you are in compliance...no harm (some inconvenience) no foul.

The guy ranting about "unfair" and "unjust" is generally out of compliance...that's why he got busted.

where does it say you risk arrest in the law for not having your grow op locked? i understand that it says it must be, but what would they actually charge you with? imho their search warrant should have been considered null and void the second you informed them that you were a card holder, as the law states that when they petition the judge for a warrant they must disclose that information. understandably they obtained the warrant under the premise that it was not a legal grow op, but the thing is, they can call MDCH to verify your status with the program, though they will not disclose medical reasoning, and that is where it should stop. i personally would contact a lawyer, but you would possibly be discouraged by the possibility of retribution. also, imho the cops were extra polite, and non-intrusive, because they were probably well aware that anything they would charge you with would have probably been dismissed due to unreasonable search and seizure.

If it's not locked (as you say you see in the law) it's not in compliance, and they can, and will shut it down . It's a code violation. You would probably be allowed to resume, once the code corrections are made.

Being a legitimate cardholder or cg, doesn't mean they can't inspect you. (read the cg paperwork..a cg CONSENTS to inspection). It just defines the conditions you must meet if inspected.

Calling, and verifying your status, was intended to allow LEO the ability to determine what they are looking for. Not to protect any one from being inspected.

the main purpose was for traffic stops. You get stopped, cop finds an oz..calls and confirms you are registered..comes back to the car and says have a nice day. (he may still give you the speeding ticket) but it allows for quick disposition of the cannabis issue.

Actually if you apply for cg status, you AGREE to inspections. for a patient self grow, your right. There is no provision for inspection. And this was not a random inspection.

With or without the right to inspect, the police certainly have an obligation to investigate when they get a complaint. I can't remember the reason for the warrant, but I believe that there was a complaint filed..resulting in the warrant. In that instance, the police were simply following up on a complaint. Where is the problem? I agree that it's traumatic for the kids to see, I agree that the cops sounded arrogant. I'll even agree that the cops could have done it in a more civilized manner.

But I don't see where the police violated any rights. Nor do I see who couldn't read the law..unless it was you.

Then could you please show me the part of the law that calls for inspections for caregivers?

This should be real good.
