How was your Easters everyone!? Mine got off to a rough start, was picked up for an oui around three am. Just for out of court with my date, I didn't qualify for a court appointed lawyer so now my question to you is how bad could it be? I refused a breathalyzer so that's an automatic 180 days, my priory are not related to motor vehicles at all and have not been in trouble since 05. I'm assuming I'll be forced to take a driving course and possibly some drinking classes (which I'm abstaining from for the course of the punishment).

Bassically I'm asking if I represent myself is there a way to really fuck it up? First offense seems pretty cut and dry on possible outcomes, I did forfeit my ability to get a Cinderella lisence with refusal of the test. I'm not trying to beat this case if you will yes an oui is not stellar to have, but I did deserve it and am not one to run from any punishment that may come from my actions.

Sorry to hear you caught a case. Although I've not heard of an oui, I'm assuming DUI because of breathalyzer. Actually a good criminal law attorney can usually help. I'd go visit a couple guys who specialize in this type of case. They'll have information specific to your case and the venue.

DUI in CA is fucked !

7 years of higher $ insurance for starters, jail, towing, impound , HEAVY fines, license suspension , not worth it at all..
sometime it pays to hire attorney, either way it cost a LOT, with or without

too bad you weren't on your dirt bike you could've out ran those bitches easy fuck em !

Yeah an oui is a DUI as far as I'm concerned I was in a mcdonalds parking lot do maybe that's why it's not a DUI? Not too sure. As far as the fines so far, I'm only at 40 to bail out. Car was driven not impounded, hopefully they won't reach the long dick of the law out on me, the judge seemed fair.

I'm not sure the repercussions of refusing a breathalyzer.
Or if there's a difference between OUI and DUI.

I can see what you're saying about getting yourself in more trouble. Judge throwing questions about why you refused the breathalyzer etc.

Given your situation I would hire/ talk to a lawyer like what C2G said. I've sat in on a few DUI cases. None of them similar to yours as far as you being parked and refusing breathalyzer, but.

If you were in my state and OUI is similar to DUI, I would expect anywhere from $700-$1200+ fines when all is said and done. Substance abuse classes. Could get license suspended for 30+ days. Probably have to reinstate it. Vehicle insurance will go up when they find out about it.

Were you actually parked? Were the keys in the ignition, was the car running? Did you have a friend who was relatively sober with you etc... Yeah you need to see an attorney.

Sorry to hear of the troubles Indy. I would definitely talk to a dui lawyer. My state has something called an ARD program for the first time. Maybe your state has something similiar. Maybe you can get off on some technical shit. I'd drop a couple hundy on a lawyer and see what he/she says.
