Looks like the new Acting DNI is withholding a whistleblower complaint and is set to be another body jumping in front of Trump on Thursday. At some point this sets up Barr vs House Democrats with all these people if there is nobody to serve the arrest warrants? Basically a foot race to have enough bodies between Trump and January 2021. Even if Trump gets the presidency he needs both the house and the senate to avoid trouble it seems. If it turns out Trump trolls can pull off winning POTUS for him, the republicans have what they want can can just impeach him in 2021, so they can keep stuffing their Wealthy White Heterosexual Male Only agenda judges down our throats.

WASHINGTON (AP) — The acting director of national intelligence is refusing to comply with a subpoena to turn over a whistleblower complaint , setting up a legal showdown this week between the Trump administration and a House committee.

The House Intelligence Committee chairman tells CBS’ “Face the Nation” that intelligence chief Joseph Maguire declined to release the complaint because he was instructed not to by a “higher authority” since it involves privileged communications.

Democratic Rep. Adam Schiff says no intelligence director has ever refused to turn over a whistleblower complaint to Congress.

Schiff says the committee will “do everything necessary” to get the complaint.

The committee is requiring that Maguire testify Thursday unless he complies with the subpoena.

Schiff isn’t revealing the subject of the whistleblower’s complaint.

According to Mr. Schiff, on Aug. 12 a whistleblower within the intelligence community filed a complaint that met the legal description of a disclosure involving a “serious or flagrant problem, abuse, violation of law or Executive order, or deficiency” related to funding, administration or operation of classified intelligence activity. Neither the subject of the complaint nor the whistleblower’s agency has been disclosed, but the complaint was deemed of “urgent concern” by the intelligence community’s inspector general, Michael Atkinson.

Mr. Atkinson sent it to Joseph Maguire, acting director of national intelligence. According to the congressman, a preliminary review by the inspector general determined that “there are reasonable grounds to believe” the information “is credible.” So far, this is how the system is supposed to work under the Intelligence Community Whistleblower Protection Act of 1998 and subsequent presidential directives and laws. Mr. Maguire, the law says, “shall” forward such a whistleblower complaint to the congressional intelligence committees within seven days.

When millions of Americans did NOT down tools and march into the streets in protest and threaten to shut the government down over Buckley v Valeo and Citizens United, that's how we let this happen. And until we do, it will keep happening.

What do you think the chances are that this turns out to be someone planting a complaint of something stupid they are withholding just to troll the media. Basically Trump had it filed just for the purpose of not giving it to congress, leaks it to the press and Schiff so that they scream bloody murder. I think it happened after DNI Coats quit, which of course makes it more interesting to think about if it would make sense he wouldn't plant a fake story for Trump.

Is Maguire violating the law by withholding this whistleblower complaint from Congress?

Yes, and maybe no. The question is better phrased as, is Maguire impermissiblyviolating the law by doing so? He is clearly violating the ICWPA by withholding this complaint, but the ultimate answer hangs on whether he had a legally cognizable reason for the violation. It’s no different from someone who runs a red light (technically violating the law) to avoid an accident (a valid defense under the law). However, even if a court found that he had no valid reason, he would not be guilty of any crime unless Congress chose to hold him in contempt, which the Justice Department would certainly oppose.
God this stuff is annoyingly complex what Trump is pulling off. Combined with the judges Trump is stuffing its hard to have confidence that he wouldn't get off if he did everything he seems to have done.

He made some sort of promise toa foreign leader that was so shocking even for that pos that a whistleblower stepped forward and now republicans are desperate to block the release

Who will be surprised when the foreign leaders name rhymes with schmootin?
Putin is smart enough to pull a whistleblower troll with Trump knowing that American government officials are on the line. He could have told Trump to say something to watch what happens when he withholds it, and at the end he gets to say 'I told you so, no president should go through this intrusion' bullshit to throw shade on the Mueller report and any other investigations we don't know about.

I just can't trust anything until it is said by the courts anymore without at least checking for angles Trump could be trolling us from. These guys are real dicks to use their offices to troll the American citizens (or whatever nation you may be from if you elect your officials, you'll inevitably get trolled too if you haven't already).
