DA says I have a strike but I didnt plead to a strike. please help

I got charged with hand to hand sales of a ounce of weed wich there scale was off so they have it down at 27grams. in my complaint the DA is saying that i have a strike. the last case i had was a assult with a fire arm wich was pleaded down to a lesser charge. they never went over terms and conditions of a strike with me i never even heard the word strike so for the past 5 years i have been walking around with a strik and didnt know it. Im wondering if i can fight that strike cause there wanting me to do 2 years at 85 percent and if i go to trial and lose 8 years. for 27 grams of weed in california

damn im allready 11400 into fighting this now im about to be another 2500 in. I could of bought a bad ass chain to floss

Hmm im confused bro im from California as well. Had a friend with a strike against him get caught with about 25.5grams and just got a 100$ fine. As the new law dictates. I think you should show this to your lawyer.

I talked to another lawyer and he said that they have to prove my strike. so if i wasnt properly advised i could very well get it off. or if they take the 1 year deal that my lawyer put in that the strike will be striken and i will do 8 months 20 days in county with a early kick most likly because alot of prisioners are coming back from tracy to the county jails in october

thats another thing that i need to clear up. cause i think it was 5 years from when the actual crime was committed but around 4 years from the time that i pleaded guilty to it. they have that on the complaint as well commited a felony within 5 years

yeah but i sold it to a undercover officer durring a sting. recorded money video tape whole 9 yards. its legal to possess but not to sell. only donate to the clubs for that matter.

now if i would have asked him for his card this whole problem would be as simple as that ine you are talking about cause if he didnt produce his card i wouldnt of sold to him. to tell you the truth i really didnt care thought it wasnt a big deal "just weed" thats even what i told the cop on the phone. he asked to meet me at another location cause there were cops across the street and i told him "im not trippen its just some weed bro" lol

I had a add on craigslist. along with many other people but my weed was alot better and i wasnt verifying everyone like everyone else did. my friend still does it and we talk to cops all the time they try to get you to sell to them without a card and they allways have a gud story just have to be a dick

its kinda a gray area. but for the most part if your doing biz with another card holder its allright. at least you know there not a cop

where in cen valley do you live,i doubt u serve more than a couple days if anything.a freind of a freind got caught with a 3lbs,scale and on probation,got no time....even with priors.they dont haave the room right now in jail or prision.

yeah id say you are safe,they are moving all nonviolent prisioners from prision to county.most likely they will just drop it.they are just trying and scare you for a while..are u a med pateint?good luck on that!

my lawyer said the same shit. they are moving all the prisioners from tracy back to there counties. they are not going to drop it they want to give me years. im a med patient but it was hand to hand sells to a officer. i think my only hope is like you say they let me ot or let me apply for house arrest after i got a little time in jail in. like my last 6 months of my sentence maybe i could get house arrest lol but shit maybe i will just wait it out and see if i get a kick. i mean were talking about 27 grams of weed.

and to top it off i havnt been in trouble in 5 years. i got out of prison and got off of parole in 13 months. but there not showing me no love.

ill tell you this much tho they think there going to hold me down there going to turn me into a beat cause when i get out im blowing up. I have 2 places to put 7 lights in one and 3 in the other and those are on lock even when im in jail cause family lives at the grow houses but when i get out its fucking on. im going to get in the 30 light range and pump out 20 pounds of out door every season..... yeah sounds gud but the only thing i could think of would be how much work it would be. i can barley hold down two grow houses and take care of my kids and girl. id have to hire a employee. and you know how hard a right hand man is to find
