Texas marijuana laws>?

Getting executed for a plant or getting life in a prison for a plant? Come on, have you EVER heard of anyone getting put in a firing line in any western judicial system? Texas likes to use its death penalty, but only to put down killers.

It goes without saying that cultivation in and of itself, is not a violent crime, you'ld have a hard time convincing a jury anywhere that a man is guilty and should pay the ultimate price.

First of all, it's "paisa", derived from the Spanish "pais" meaning country. It's sort of like Spanish for "hillbilly". Legal status has nothing to do with it. An individual can be a legal citezen and still be considered a paisa, but you're right about the no English part.


Back on topic, I find it strange that NORML wouldn't list Texas cultivation penalties.

This is a great question I wish someone could actually answer, instead of posting sarcastic comments like "call the police and find out"- I don't understand how this is not considered a legitimate and important question, is it better to be ignorant of the law? Obviously we have tried to find the info, and were only asking for help from someone else who might be more knowledgeabe- which isn't you, so quit cluttering this thread with you're bullshit.

Penalties for cultivation in Texas are the same as for a delivery charge of the same weight. they just see it as a manufacturing/distribution case. I spent three years working in a law library while i was in prison.

Texas doesn't have cultivation laws, they strip off the stems, weigh the green stuff, and charge you with possession. Then your lawyer can subpoena the evidence for a re-weigh when it's dry or better yet when it’s molded and unrecognizable because they put wet plants in sealed bags. Sort of depends on how educated your local pd is on the subject. This all of course if you get caught with just plants and no grow equipment.

Yes Texas DOES have cultivation laws on the books; replete with legal definitions for cultivation. Like i said before; the penalties are commensurate with a delivery charge of the same weight. Just as a for-instance, possession of up to 4 Ozs is a class A misdemeanor, however, delivery of this same amount bumps you up to a state jail felony which carries from 6 months to 2 years. So in reality, a first time offender growing less than what will dry up as 4 ounces will likely get probation (a trap! don't take it!!!) or a 6 month sentence which you can get commuted to county time and serve 2 months.
I personally know a guy that got caught IN THE HOUSE with 4 bedrooms crunk to the gills here in Dallas. His idiot homeboy opened the door to constables who were looking for the prior resident for some bullshit traffic tickets... blah blah blah, long story short; this guy had two prior felony convictions and got 2 years probation for a 24k watt operation. Of course he went to jail 5 months later for a dirty UA, but still....

Delivery is not given for plants everytime, possession is also an option.

Probation is BS and if you plan on smoking take the fines or short stint in jail.

In texas you will be charged by the weight of your plants and the fine/ time goes pretty close as norml chart.. depending on where you live in texas the actual sentence varies. "If your growin ur goin." Small scale couple plants will possible land you probation and fine.(first offense). You have to realize not everyone grows indoors. Not everyone has all the equipment you have jammed in your closet, basement or attic. Keeps ounces curing at all times. Your local police may lack on the subject, but there not fucking stupid. Growing one plant may not get you hard time, but grow that plant within a couple blocks from a school and your sentence could go up... It all depends on where you live what ya got and, whats up your judges ass/twat that day.

Well since the op ran this I guess Norml has added their Texas law review. It's all there black and white. I sure as hell wouldn't be caught dead in that state but it has more to do with the mentality of the population and less to do with the absurd laws those people have passed.

Texas ain't got shit. I'm a native Texan, born to native Texans. Family got there in 1828 while it was still MX. It should have stayed that way. The laws suck. Most folks in TX are great people - the elected leaders are not.

Not only does it take a constituency to elect a leader, that constituency also has the ability to recall said leader! The people of a state are the only ones to blame. Lawmakers pass laws that will in turn get them re-elected. It took a majority of people to be racist for the enactment of Jim crow laws in the past. It took a majority of people being racist for the south to secede from the union. If I am correct there is an obtuse number of texans partitioning the government, as we speak, hoping to secede. While I am sure that not all the people in Texas believe in the style of governance that is imposed apon them, I can say that a majority of them do. That means while I walk down the street in Texas more then 6 out of ten people I see believe In the political governance provided by such luminaries as George w bush or Rick perry. In any valid democracy the leaders of state are a direct reflection on the general mentality of said state. Some people try to say that the representation is skewed because around 40% of voting aged Americans do not vote but that, in and of itself, is indicative of the American mentality. We have no one to blame but ourselves!

Money talks and buys the way in every state. Texas is no different. Those who have it want to keep it and keep it from you at the same time. Therefore the rich finance everything both ways if it serves their purposes. Think no super rich US citizens are involved in the illegal drugs business? The longer people stay away from growing it the more they get selling it on the black market.
