Felon with gun

But I should have been a little more specific i guess. No I do not know what crime landed this guy a felony but there is a good possibility that it was a violent crime.
I won't sit here and defend a felon just because the other team is the police (pigs).
I think there is a lot of bias going on in this thread and generally like to stay neutral(if there's anything I like more than fighting it's watching a fight!).

Ok, so you didn't get caught! Imagine you were busted for experimenting with drugs when you did, and got popped, resulting in a felony? Would you still share this sentiment? Obviously you aren't a criminal, and you feel you deserve the right to bear arms right? I understand your position, but am torn between the laws and logic!

Note how i never admitted to using those drugs but you got me.
Yes I may have a different outlook on things but I probably wouldn't carry even if my life depended on it since if I do, and get caught, it would mean a/another little stay in federal pound me in the ass prison.
To me that seems like it would produce someone with a tendency towards violence. Someone that really has nothing to lose.
And yes if you have the right to carry legally ,carry that fucker responsibly .
I can't believe the sentiment here . I suppose we'd have to look at statistics to have an idea if a majority of violent crimes are committed by, as the op put it "ex felons".
If it were fact then my idea of this and the discretion the pigs use isn't really far off.

I have people near me and I don't want these people hurt by some fucker who is carrying and shouldn't be. Given that, the odds of someone close to me getting shot by any one carrying a gun go down.

Yeah I agree, there are plenty of dangerous idiots out there! But not all felons deserve to be treated as hardened criminals and stripped of rights (my point) not too far off topic. Perhaps drug possession should not carry a felony sentence?

Sounds like to me like that guy was a stupid fuck who deserves to be in jail.

Also in a car with a gun and a felony is retarded... I agree the op friend must be a violent criminal! I can only speculate! But if you have a felony you should just stay far away from firearms.... Get a sword or a bow and arrow for protection! It's not worth it!

In several states after 5 years you regain your right to posses a firearm, vote, ect. ( 5 years without being arrested that is) as long as you have nothing violent

The facts are simple, he had a pistol in a car and got pulled over, knew he was fucked if he got caught, was answering questions in a way that either drew suspicion or pissed the cop off. The report is going to say something like he was hesitant with his answers, had flushed skin, avoided eye contact, ie probable cause. Why make it about profiling or think it was unreasonable, im a felon and have never had my back seat torn out in a stop. Its not like they tore the backseat out and then found the gun. They had suspicion he had something by his body language, did a routine search, found a pistol within his reach, decided to really search the car at that point and tore the backseat out. On a side note, if when you get pulled over, you decide to get a shitty attitude and act like an asshole, expect a search. Its not profiling if your holdin, its intuition, if you keep getting searched and dont ever have shit thats profiling. Cops can be a pain in the dick but theyre not dumb and are a necessary evil

Not all people with felonies are dangerous, or have done anything dangerous. I have a class 3 felony for retail theft. its almost 5 years later now, so I get a real good chance of having the felony eradicated from my record. Since then, I haven't gotten into much trouble at all, just a little possession charge here or there, and where I'm at, possession is basically a slap in the wrist, till you get caught with something large, or bagged up separate. I still abide by the laws though, and if I'm stopped by a policeman officer, then I comply with what they say, no matter what. That way they can't say that I was non-compliant. One of my people was giving me a ride home from work, and he had a qp in the trunk for me. We got stopped because the temporary license plate was not legible in the window, and he was taken to the police department for questioning. He is your typical "thug" young, black, has dreads, says "hey G" a lot, I am also a minority. We talked our way out of it, by keeping our cool (the officer said originally the license is not readable, then he switched to "you don't have a valid drivers license") Well, I did have a license, so I got to drive home, and hide the qp, my guy went to jail for about half an hour, then they released him. You can still be stereotyped and get away with it, but I have never tried bringing a gun with me, or having one in my possession. That is just one more hindrance that could end with me back in jail, and this time I would probably have to serve my whole sentence instead of getting let off easy (I never actually served any time) As long as you keep your cool and give the right answers the cops will usually leave you alone (the one particular cop that arrested me in my earlier post still follows the letter of the law, but he definitely toes the line as far as he can, that's why I stopped bringing a joint to work with me, so next time he happens to stop me for no reason, I can actually get him with harassment (so far he has been really lucky, and I have been really unlucky, I don't carry weed on me everyday by any means, and its always ready to smoke, so they can't say I'm trying to sell it, and he has been very lucky to stop me, and search me when I have it on me) if the cops stop you for any reason at all, they can search you, you don't have to consent to it, but they will search you anyway, and once they find something, they have a means to justify the stop in the first place, even if they are grasping at straws to try to get you

Conviction 2003 he got out of prison in 2005. No police contact since

I bailed him out courts on Monday so lets see how it goes

5 years and the felony disappears? I Wish I lived on that planet! I believe a pardon from the gov is the only thing to help remove felonies! they usually aren't even considered till 10 years clean if I recall, That's what I got out of California's pardons! Maybe other states are diff?

no as long as you toe the line and don't do anything too offensive (I got a dui, technically not a dui since I wan't legally drunk, but the cop was a racist, I got it thrown out though) you can petition to have it sealed, or expunged, i can't remember which word they use. Basically it disappears to anyone doing a background check who isn't uncle sam. However I do have to do something in order to make that happen, and I will probably have to appear in court for it when the date comes in a few months

In this day and age with current technology, I think the public would be better served if ALL police actions were mic'd AND video recorded in their entirety, otherwise I don't think an officers words should carry more weight in court than a citizens without the recordings.

It's like when I got pulled over and the cop told me smelled marijuana and I know for a fact he did not. (He was profiling, no one had smoked and there was none in the immediate compartment of the vehicle.)

I told him after I got my tickets that he was profiling and he didn't smell anything. He stuttered and told me If I felt that way to plead not guilty.

I laughed and told him I'm not dumb. There is no way in a court of law that I can prove what you smelled or didn't. That is why smelling marijuana is objective bullshit.

He can't prove it and I can't disprove it so why is it acceptable as reasonable suspicion. The court has to take his word for it.

Do you think there is ever any hope that the supreme courts will ever see it this way, though? I mean, 2013 and the 5-0 can search anyone they want to, anytime. They lie about what they smell, and then they use a tool (k-9) that has virtually no over sight and allows any handler to abuse their k-9 to alert whenever the hell they really want it to. So cop 1 says he smells pot, cop 2 false alerts his dog, and before anyone knows it the fucking cops are literally tearing through your vehicle regardless if you really have anything or not. Two little lies is all it takes for them to have any citizen in the corner with no options but to take it.

What are the real stats on k-9 searches, anyone? I've heard 8 out of 10 searches where a k-9 unit gave a positive alert, that that no contraband is found. Any truth in this?

If he was profiling and their was no way he smelled bud then what did he ticket you for? You do realise that to someone who isnt around bud every day and especially someone who doesnt smoke bud, that shit lingers for days and days in a car and stays on you until you shower and wash your clothes.
